Need proper advice please on DLA

hi to cut long story short, ive been off work due to my health for over a year, i put claim in for esa 3 weeks ago, im entitled but it had a huge negative effect on my houisng and council tax benefit.
my partner is on smp
we get working tax
child tax
housing ben
council tax ben
i cancelled my claim for esa,
can i make a claim for dla.
what effects does this have on the above, will i get it due to partner working?
what effect does it have on housing and council tax benefit and tax credits.?
my consultant and surgeon at the hospital have said itll be a year or so till im back on my feet but will have some problems for the rest of my life but will be much better
i have to prolapsed discs in lower spine, crushed nerves, and also atheritis there aswell causing my problems.
where do i stand, i dont claim anything at all, live with partner and have 5 month old baby

To make a claim for DLA, you need to have had additional care and/or mobility needs for at least three months, and expect them to last for at least a further six months. Do you have any care and/or mobility needs?
If you do claim, and are successful, it will have no bearing on anything that you or your partner earn, as it is not a means tested benefit. It is supposed to help with the additional costs of having a disability.0 -
yeah ive had needs of help for last year or so, partner helps me out of bed, helps me shower, and also to put socks on and to help dress.
as i cant stand for long and have limited moveabilty i cant bend walk for long distance etc
partner does all care with baby
will i need sick notes back dated from 3 months ago0 -
It might be worth you putting in a claim for DLA, but obviously I can't say whether you will get it or not. Any evidence you have - hospital reports etc, can be included in your claim. It takes quite a while for you to get a decision, often around twelve weeks or so. This can be longer if DLA write to somebody conneccted with your care, such as GP, hospital specialist, or physiotherapist, as they have to wait for a reply.
I don't know what effect any of this would have on your housing benefit etc, as I have no experience of this. If you don't get many answers from this board, you might want to re-post on the Disability and Dosh board.0 -
I`m glad you took my advice on the loans forum dazza and are looking into DLA,it certainly sounds like you have a claim and it wont have a negative impact on any other income/benefits.

Are you actually saying that because you claimed ESA your overall income/benefits were reduced by more than what you were getting on ESA??

Hi Dazza,
The DLA wont affect your housing benefit or council tax. We are claiming DLA for our sons with no negative affects. The claims do take a fair few weeks to go through but are backdated to the date they put on the forms. You can also make the claim online. If successful with the claim and a middle rate or above care is awarded then carers allowance is something else that can be looked into.0 -

I find that really strange.
i found it strange to start with, but its classed as a income with esa contribution based. and it took are earnings up by 250 ish a month aswell as tax credits etc
i did question dwp and council and this si what i was informed by them even tho 2 weeks before i was told it would have no effect and may even get more help.
i have no applied for dla online, i have given all doctors details and speacilist details, i dont have surgeons details as yet but im sure the spinal consultant may pass that info on.
i have looked at eligibility over and over and i feel i qualify for it, but as most people know doesnt mean i will get.
if i dont get it then i might appeal or just leave it. i will be back to work late next year after ive had my op and stimultor done.
so what do they do, contact the doctors, and also the person who helps me daily for statements etc?
or do they just do what esa do, have an assesment period and then you have medicals?0 -

yh i have to do something, money is so so tight at the mo, and i dont actually bring anything into the house money wise. its worth a shot i feel, worse they can do is say no, but my consultant did say few weeks back dont expect to get back to work for around a year and you are going to have a lot of pain for months, they going to do a spinal simulator first then will go for the op mid 2011, then recovery upto around 8 weeks, then i should be ok to do work all being light duites for a while, but at least i can get back into work and earn money.
fingers are crossed. i think im eligable anyway0 -
Do you realise that the council can reduce your housing benefit/council tax benefit if there is a benefit you are entitled to, but refuse to claim in order to receive higher payments of HB/CTB (in this case, contributory based ESA)?0

if you have given your GPs details as someone to contact then i suggest you see him/her asap to make sure they understand your care/mobility needs as they will be contacted.0
