when a builder did a runner after waiting for my cheque to clear, my bank (Barclays) told me afterwards that they could have taken the money back out of his account at my request. Don't know if this woulc be applicable or even possible in your case? don't see how possible theft/fraud could be classed as civil? I was always hopeful you would be OK but it's now looking unlikely and you have my deepfelt sympathy.

Because a one off case of either goods not being sent or as not described in the Police view is regarded as a matter between the buyer and seller to sort out themselves, ie. chargeback on cc or small claims court.

You only have to look at Ebay when a buyer complains that they have been scammed and they approach the Police they will say it is a civil matter, only in serious cases of fraud/deception or if enough people have been scammed by the same person will the Police take an interest.

To be fair to the Police I do agree with them, why waste Police time and resources when there are more serious crimes that they have to deal with although I have known the Police take an interest on minor fraud cases dependant on how busy they are at the time and if the fraudster is known to them in their area, so if all else fails in trying to get your money back then by all means give the Police a ring, they may be able to help or in 9 out of 10 cases will just tell you that it is for you to sort out.

Melb - thanks so much for your reply ... I kinda needed that after the last couple of days :o

fiddiwebb - I do agree and I do not wish for police time to be spent on this matter. All I can do is attempt to get the money back and if I don't then I have learned my lesson.

I will be monitoring the free ad websites in the meantime in an attempt to spot the same deception so that others don't get fleeced!

Why did you ask for advice on here then completely disregard the warnings you were given? No sympathy from me!
