I had a very long lecture this afternoon on what is an HMO and what is not. Trust me, this is definitely an HMO. As an officer responsible for enforcing the licencing regulations even I find it a bit difficult to understand sometimes though.0

Sounds like we are now classed as an HMO then. So does that have the same implications for council tax that it did under the old system? I hope so because it is pretty unfair for someone who can only afford to rent a room in a 5 bedroom Edwardian semi to end up paying council tax on the whole property because the rest of the tenants are students and if it is the case then my housemate is being considerably overcharged. Would there be other implications (apart from the sinks in rooms thing which I don't care about anyway)?
I did try to find some info on this relevant to my local area but I can't find anything on the Trafford Council webiste that refers to the new rules or the 2004 housing act. On the Machester city council website it says that anything occupied by three or more people is an HMO but it only has to be licensed in the following circumstances:Mandatory HMO licence
By law, your landlord, or their agent, needs a license if you live in a house in multiple occupation (HMO) anywhere in Manchester, and . . .
1. the building has three storeys or more (including useable basements or attics); and
2. it is occupied by five or more people; and
3. those people form two or more households; and
4. tenants share some amenities like kitchen, bathroom or laundry.
Our house is two storey. We do not have access to the attic. We do have access to the basement which we use for storage and have some exercise equipment down there but it has not be damp-proofed and converted for habitation. Also we live in Machester rather than Trafford. Do you think our landlord should have an HMO license? Does it make any difference to us either way?0
