ccj and claiming on insurance

we have to make a claim on building insurance, due to damage of our property, will this be jeopardised if i have ccj? we have insurance set up with other owners,
Have read horror story of company not paying out 0.5 million because owner had £600 ccj, i am not a director just pay share of the insurance contribution to building and i am one of the freeholders, my ccj is not connected to our company at all

    As long as you answered all questions correctly (which could include some sort of question regarding CCJs) when applying for the insurance then this won't affect your claim.

    I can't see that an unrelated CCJ would have anything to do with any Buildings Insurance claim.

    If they needed to do any background checks as part of the claims process, then this would only direct them to ensure that no cash settlement formed part of the claim.

    Sometimes when matters get reported in the press, they don't tell you the whole story. Perhaps there were other factors involved.

    hi thanks for your reply, but i wasnt involved in signing any of the paperwork, this was done by our director and secretary ( the owners of the other properties). really the question is is there any reason why they would need to know my circumstances? as i am one of the freeholders, not a director

    Not really. Only if there was anything suspicious about the claim.

    Why? Do you have something criminal on your record? (A ccj against you isn't a crime)

    can anyone advise me whether they are like to credit search me, i really dont see the relevence if they do, it just seems like a tactic to get out of paying

    Stop worrying over this.

    It would be highly unusual to make credit checks for most Buildings Insurance claims.

    Sorry guys, but yes you do have cause for concern, during the beginnings of my flood claim which is still ongoing, my insurance company credit searched me and tried to null and void my claim by saying I had not declared my ccj.

    If you have declared it, no probs, but if not they can do this. I did my original details over the phone and was asked something like, have you ever had any ccjs, have you ever been bankrupt and do you have your accounts regularly audited by an accountant? I recall saying that I had had a ccj, had never been bankrupt and that as my business was a new one I did not have my accounts audited yet because I did not have any, but it was my intention to do so.

    They did credit check and found a note I had put explaining that the ccj I had was actually to do with a charity I ran and not a personal one. Albeit the actual ccj had expired and was not on my records, they said I did not declare it and refused my claim. It was reinstated. Then they tried to say, as I
    could not provide my accounts forthwith, obviously I did not have them audited either, so tried to get out in that respect! I explained the issues that I had had with flooded paperwork and crashed computers with all accounts info etc and that I had to reconstruct the accounts and I was awaiting info from the bank. To date I have given them my turnover figures, threads are not enough theynwant the whole accounts! I have not given them yet, because I am too busy dealing with the disputes over the extent of the work and the mistakes they have made throughout, one thing at a time! Now, they have cancelled my cover altogether, stating I have not declared information of who I have living with me onsite, stating I have DSS clients! I have a guest house and I have been in alternative accommodation (which they refused to pay for) for seven months, so nobody is living there! & so it goes on, tomorrow will be something else!

    I am sure they have cancelled it, because I was stupid and said the other day that they better hurry up and finish the work because it is this time of year it usually floods!

    This is sewage from the local pumping station that can't cope and trips out, not the river, rain or whatever!

    Just be careful and read all documents that come through the post and check again, I naively thought that what I said on the phone would have been quoted, no a simple yes or no tick in a box, which asks three questions in one sentence!
