    Is your illness/disability in any way work related, for example as the result of an accident that happened in the workplace?

    You worked for the company for 13 years before going off sick, and you have been off sick for the past 2.5 years. That would mean that you would be in receipt of contribution based incapacity benefit, not income related ESA. (ESA was only introduced 12 months ago and existing IB claimants have not yet been migrated)

    Can you clear this point up please, because how company sick pay is treated depends on which benefit you are currently receiving.

    Re holiday pay - you accrue holiday pay during the year, even if you are off sick. This is not a 'new law' but clarification of the existing law, which means that it applies for the whole period, not just the period since the ECJ clarified the law. Under the law, holiday pay cannot be rolled over to the next year, but the question of whether this still applies to someone off sick for the full period is something of a grey area, as it has not yet been litigated.
