They need to replace me at work, as i worked nights and there was only 2 of us. The other person on nights with me has been on his own for the last 2.5 years. Can they not replace me till they have sacked me.0

Yes they are coming tomorrow at 14.00 To my house they have said that you do not accrue holiday pay when you are of sickFor 2.5 years you have been accruing holiday pay.
They have every right to ask for a meeting in a place of your choosing, it does not have to be at your home but you really do need to talk to them.
Have you agreed that this meeting will take place at your home?0 -
I would really like to think i would be able to return to my old job. But as to a time frame im not sure. Have you got any indication at all of time frame? Is there anything that can get you back to work any time soon?
From their point of view, this is a long long time and some other companies would have retired you on medical grounds or dismissed for capability reasons a long time ago [as I am sure you know]....so if you try to give them something to hold on to then you might stand a better chance of a resolution that you are both happy with.If you haven't got it - please don't flaunt it. You do accrue holiday since a new ruling came in from when you are off but the ruling came in sometime after you went of sick so whether it can be retrospectively taken back I doubt it but since the EU ruling I would have thought you would have holidy time accruing.The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

Legislation cannot be retrospective - it generally applies forward from a date. But case law is effectively retrospective, because it is saying 'this is the way legislation should have been applied'.
