Sounds like they've gone off the report your GP made.
I think you can ask for a copy of the report though you may find it easier/quicker to ask your GP Practise for a copy rather than asking the DLA office.
Did you see your GP prior to the DLA requesting the report?

This is what I think also , but I think it may not have been the gp that I see that wrote the report but the one I am actually regisitered with.It was the gp I see that advised me to go for DLA

  • I had help from DIAL with my application. It was filled in completely honestly.

I was initially refused DLA - the reasons given seemed to refer to someone else completely! DIAL handled my appeal - again I believe they were completely honest. At appeal they changed their mind - from no award to indefinite awards at lower rate for both components.

You say that your daughter helps you - did she write a statement stating that you need help?

:( As the title says really, got the letter this morning that says I've been turned down for DLA as apparently,
i can wash and dry myself um no I cant dry myself without help from my daughter
I can dress and undress myself again no not without help from somebody
I can get up and down the stairs not without help
move about indoors not without using furniture and walls for help
get in and out of a chair again not without help unless I want to cause conciderable pain to myself.
The list of things I can apparently do goes on and on and on It is like they have put a different claim form against my name.Do I ask for a reconcideration or do I just go for appeal.Grrrr they get it so wrong ang wonder why people now no faith in them .Lies lies lies it all is. Sorry all rant over, to be honest I was expecting a no first time round.

What did they base their decision on, OP?

the days when they gave out money without a fight are over i'm afraid.

    Totally disagree.

Personally, my DLA renewal was granted - no reconsideration, no appeal, no tribunal and no fight.

The reason people only hear negatives about DLA is because the group who don't receive an award are more likely to shout out about it.

Thanks , no Atos had nothing to do with it thankfully, fighting my corner with them regarding ESA .No they have gone on the info on my claim form and a report from my gp .Can I ask for a copy of the report from my gp, as I really don't believe that the gp that I see has wrote a bad report so I am wondering if it was done by a different gp with in the surgery.

    This post answers my query.

It is possible that your GP wrote a report that made the DM think you can do things - I'm not saying the GP wrote a bad report but it could differ from what you have put.

Anyway, someone else may have answered this - I reply as I read :o - but, yes, you are allowed to see the reports, I believe :)

Hi yes my daughter helps me a great deal, she is only 13 and I put her details down so they could contact her if they wished to.Thinking about it now perhaps she should have wrote a statement and put it in with the claim form

because they had filled out the (very complex) form incorrectly

I really don't think it is a very complex form. In actual fact, it seems very simple. You fill in how things affect you and for how long.

What parts do you consider to be complex?

My personal opinion is that it is quite a difficult form to fill in correctly, but the child one is much more complex than the adult form IMO - and funnily enough the Prime Minister described the DLA child form as "the most complex, complicated form to fill in" recently when answering questions in public. How easy or difficult you would find it to fill in would depend on your level of comprehension, education and experience, and it would be a sad system indeed if the people who struggled to fill out the forms were adjudged to be undeserving.

Sorry you were unsuccessful and I know how you are feeling right now (from past experience!) upset, angry, drained, stressed etc.

However, take the next couple of days composing a letter for reconsideration. They will have listed reasons on the letter you received of how they have come to their decision. They state reasons for both components.

Take each point and explain in detail why you disagree with their decision. I did this a few months ago and within 4 weeks I received a reply - I was successful.

Go and visit your GP to keep him/her up to date and explain what has happened - your GP will be able to tell you what was in the report. I'm sure if you have a good relationship with your GP that he/she will write you a letter to support your claim which you could enclose with your letter.
Have you asked for a statement of reasons?

I personally would ask for the statement of reasons which details why you were turned down.

    Good luck.

The last award letter I received (on re-application) stated their reasons how and why they came to their decision - this is the case even if you are awarded DLA.
