Been turned down for DLA

:( As the title says really, got the letter this morning that says I've been turned down for DLA as apparently,
i can wash and dry myself um no I cant dry myself without help from my daughter
I can dress and undress myself again no not without help from somebody
I can get up and down the stairs not without help
move about indoors not without using furniture and walls for help
get in and out of a chair again not without help unless I want to cause conciderable pain to myself.
The list of things I can apparently do goes on and on and on It is like they have put a different claim form against my name.Do I ask for a reconcideration or do I just go for appeal.Grrrr they get it so wrong ang wonder why people now no faith in them .Lies lies lies it all is.:mad: Sorry all rant over, to be honest I was expecting a no first time round.

    i went for a reconsideration, spat my dummy out, made an appointment to see my mp and within 1 week of making the appointment a young man telephoned me up from dwp for a friendly chat, 3 days later (just before my mp's appointment) awarded my dla for 5 years, no atos interview needed(they took me from higher rate originaly and dropped me to lower rate care only which is why i asked for a reconsideration), fight them if you believe you have a genuine entitlement to dla and you will get it, the days when they gave out money without a fight are over i'm afraid, good luck

    ETA if you have had an atos interview and it was them who lied i suggest you contact the dwp , express your concerns about atos to them and ask to initiate a formal complaint against atos, then refuse point blank to have anything to do with atos until the formal complaint is justified, i did, worked for me, atos didnt even get across my doorstep.

    Thanks , no Atos had nothing to do with it thankfully, fighting my corner with them regarding ESA .No they have gone on the info on my claim form and a report from my gp .Can I ask for a copy of the report from my gp, as I really don't believe that the gp that I see has wrote a bad report so I am wondering if it was done by a different gp with in the surgery.

  • Have you asked for a statement of reasons?

    I personally would ask for the statement of reasons which details why you were turned down.

    Try to provide further evidence to back up your claim & ask for a reconsideration (this worked for me) do you see any specialists that could back up your claims?

    If you get turned down again then appeal but you might want to get some advice from welfare rights or the CAB in order to make your appeal as succesful as possible.

    Hi and thanks , no I don't see any specalists now as when I was diagnosed by a rhumatologist(sp) for Fibro they said they were happy with the treatment my doctor was giving me and that I could stay under him for my care for Fibro if I wanted to.

  • My DLA award letter seemed to bear little resemblence to my case too in places so I rang them to check why. I had to get someone else to fill in my form as I'm partially sighted, so I was worried they'd added somthing/made a mistake & was worried I'd lose my award & also be in trouble with DWP for making a false claim.

    They were really helpful on the 'phone - they said that these letters are standardised in places & not to worry if the letter doesn't seem to reflect your case. In my letter it stated I needed help to was/dry myself, dress/undress & communicate when I clearly don't & thought I'd told them so. When they checked my claim form they could see I hadn't said that I did! They did apologise & said this happens quite often...

    But your case sounds like they've got a lot more "wrong" than they did with me. I did get the award I was expecting (after advice from jobcentre + & RNIB) so I was very lucky.

    It may just be as simple as an admin error which they may be able to sort out on the'phone.

    And I find that looking back at you gives a better view, a better view...

    I filled in all my own forms thank you.

    The appeal process is very stressful especially if you have a mental health condition.

    Luckily for me a lady from the National Autistic Society & my OT attended my tribunal with me.

    They were there purely for support as I wouldn't go by myself infact the reason I failed the appeal is because I opted for the paper option rather than attend in person.

    This is pretty much what I have said to someone on this forum via private mail.It is the genuine ones that have it spoilt by the scroungers and that is not a word that I really like describing people as .

    I used to work in a local advice centre and as part of that would help with DLA forms and appeals, often a genuine claimant would be turned down because they had filled out the (very complex) form incorrectly or missed out important details, in that case it's useful for someone like me to look over the form and explain things further. I've never "embellished" a form in my life and dislike the suggestion that this is what people in Welfare Rights do.

    I fill my son's forms in myself nowadays (as I have the appropriate experience to do so) but would recommend that any new claimant sought the advice of a Welfare Rights organisation before attempting a DLA form.

    Sounds like they've gone off the report your GP made.
    I think you can ask for a copy of the report though you may find it easier/quicker to ask your GP Practise for a copy rather than asking the DLA office.
    Did you see your GP prior to the DLA requesting the report?
