ESA Medical Possibly Failed

The DM gathers all of the evidence and where there is a difference in opinion, will make a decision on the balance of probabilities. This is why additional evidence is very important.
The DM is not a medical professional. The DM meeting the claimant would serve no valid purpose.
If you are told not to include anything other than the ESA50 where does the DM get other evidence from? the only time the DM will get other evidence as far as I can see is when you appeal. If all the evidence was sent at the same time, would this not save all this time and money actually having to go to appeal.0 -
In that case skinticket, your post has been reported to Abuse also. Don't rise to the trolls!Gone ... or have I?0

I don't disagree with you, the form can be misleading. However you can submit your own supporting evidence, and DM's will often ask GPs/ specialists etc for reports. When I complete forms and someone cannot afford to get their own reports I usually add something along the lines of 'I would be grateful if reports are sought from my GP and Specialist before my case is considered'.Gone ... or have I?0 -
I think because it says on the form do not send any other paperwork that if you do send it it will be discarded.. puts people off sending information that would likely make their case a lot stronger. The questions asked, or, not asked at the ESA medical dont really give the DM a true picture of what the health and capability of the person is.0

In many cases it would serve a valid purpose - they could see that the assessor lied through their teeth, and listen to a catalogue of lies being explained away by the claimaint.[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.
[/greenhighlight][redtitle]
The impact of this is to stigmatise people on benefits,
and we should be deeply worried about that[/redtitle](house of lords debate, talking about Cameron)0 -

I can see your point, but then the argument would be that the DM is not medically qualified and even in the case of blatant incapacity, their lay view would not override that of a clinician.Gone ... or have I?0 -
Even if it was shown the clinician was not telling the truth?0

I was not once asked to lay down on a bed and bend my knees, when asked to squeeze the "doctors" fingers with my bad hand I physically couldnt do it, both of these (and a lot more) are missing from my report, how is it fair that the atos "doctors" lie about what happens during the medical examination?
I fell over, and seriously injured myself, i cannot go to a place by myself, yet the decision maker decides that i can and scored me 0 points on that part, i cannot walk to the post box and back and that is lest than say 50 yards from my house without being in severe discomfort, yet the DM decides that im able to walk more than 200 metres without severe discomfort, how do they come to such conclusions when one contradicts the other....0 -
What happens at the assesment, what do they make you do, i'm dreading mine purely from the point of i'm going to be in sooo much pain and i know for days after also, I am so worried incase they do the same to me as they have done to you guys, and miss bits on the forms etc. xBlogger / Money SaverMake £2022 in 2022 Challenge - Accepted0

just know that every movement you make is monitered and they will lie and twist things beyond belief in their favour in order to give the DM reason to stop your benefits.
they told me that i would be ideal working in a supermarket, i had a serious accident in my job which was at asda, so i had to leave, i can barely walk, yet they failed my medical.
atos are a joke.0
