Sorry to hear this... Solicitors are like a law unto themselves...

I know how you feel... as I am a victim of MBSAP (My Buyers Solicitors Are Pants) Syndrome... we were supposed to move on the 18th August, then the chanin collapsed because of the solicitors lack of action, with a new buyer found we gave them 8 weeks to sort it all..... guess what... we haven't exchanged and looks like we wont complete next week (at which point we will give up and I will have to find a new job - we were relocating).

    Hurrah, isn't this fun?

Housing association (vendor) set me an exchange deadline of 18th September, which they have since extended and extended because their solicitor has been completely useless.

Their solicitor left the company on Friday and has been replaced hopefully by somebody more efficient (well I can hope!) and just to complicate matters, MY solicitor's assistant (who's incredibly efficient, turns paperwork round within a day and chases things several times a week) has been on leave for a fortnight and is now off sick. Oh joy. Luckily, her secretary seems to be on the ball.

As far as I know, there's only one query remaining unanswered SO WHERE IS IT!!!?!??!????

Can I join this club as well!!

Our solicitor sent enquiries to our Vendors solicitor on the 7th September, last week I found out he couldn't answer the enquiries without contacting the local council (bungalow has a conversion which was done 20 years ago but no one has any supporting paperwork) so now we're waiting for them to return paperwork before the solicitor can return the enquiries (even though he was sitting on them for so long) our Vendor thinks we're exchanging on Friday because thats what the solictor told her yesterday apprently everyhing is done there end! I don't think so somehow!!!
House purchase completed 6th December whole process took 4 months.

I hope that the email I sent to my solicitor's secretary this morning (conveyancing assistant is off sick) doesn't sound too desperate :o :

    Dear *****,

Assuming that you have still not received the answer you are awaiting from the HA’s solicitor, I urgently need you or ***** to speak to her, not just to chase for the actual response but to find out specifically

    1) what is causing the delay, and
    2) when it will be resolved, if not today.

As I explained to ***** at the beginning of this process, the HA is offering me an incentive of £2k for exchanging “by the deadline”. The original deadline was 18th September, and the HA have extended this 3 times now as they acknowledge that the delay is at their solicitor’s end. The current deadline extension takes me to Friday of this week, and if the HA are to extend it further, I fully expect that they will expect me to demonstrate that we have been making every reasonable effort to chase. I know you have chased this several times by fax but please, phone her and try to speak to her direct, as this gives her less of a chance to fob us off.

We are now one month beyond the original deadline, and nearly three weeks since ***** last wrote to the HA’s solicitor with queries. I’ve had my mortgage offer in place for almost two months, and was hoping to have moved in by the end of September! The HA’s solicitor owes us some answers, and if she cannot answer the query at this point, she at least needs to tell us what she is doing about it and how long she is expecting it to take.

If she refuses to commit to an answer, or fails to return your calls, then at least I can report this to the Housing Association to demonstrate that we have been doing all we can!

Thank you very much for your work on my case so far; I’m copying this message to [your boss] in case this helps to move it along. I will phone later in the day if I haven’t heard from you.

    Regards
    *****

    Offer accepted: end of July
Paperwork submitted: first week of Aug
Contracts expected to be exchanged: early September
Contract actually exchanged (buyer signed and sent contract to his solicitor to be filed): late September

Since then there has been *absolutely* no news from buyer's solicitor. It'll be 3 weeks today. Now I've threatened to pull out of the deal if we don't complete within one week. I'm losing almost £300 a week in mortgage payments and bills!
  • WE HAVE A CONTRACT!!!! AT LAST - 10 weeks to the day since we put the offer in!! Just got searchs to go now..........................another waiting game!! Great fun!! This may change to MSIP Club!! (My Solicitor Is Pants)

    Well done RachaelC!

Keep your fingers crossed for me - we still have one query outstanding (after 3 weeks of there only being one query outstanding!) and vendor's solicitor still isn't returning my solicitor's calls...

    Fantastic news for you

Bargain Rzl - We're in the same club as you waiting for one enquiry out standing! Very Frustrating! Vendors EA admited to me today that her Solicitor doesn't work fast!!! Doesn't help us though!
