My partner and i are currently in the process of buying our 1st home. We put an offer in on 4th August and it was accepted on the 6th August - we are 1st time buyers and the house is currently owned by a relocation company- full steam ahead or so we thought.............
We have had our mortgage offer letter etc for 5 weeks now, and STILL havent had a contract from their party!! Our soliciot has telephoned their office twice, and was promised someone would phone her back, then she phoned for a 3rd time and was told that the person they 'THINK MAY BE ' dealing with the case was away that day!!! They dont even know whose doing it!!!!! We have contacted the estate agents, who have also been getting on to them, but still...... no contract!!! What do we do now??? We were (according to our mortgage offer letter - as there is no chain) suppose to move in on 16th Sept, but haven't!!!
We had ordered all our furniture etc which we have now stored at my parents, but have not got a clue as to how to move them from A2B. Would we be within our rights to send their solicitors a stinking letter and inform them that they will be paying for the cost of a removal van as its their incompitance that we have had to store the items (Nothing was delivered before the 16th Sept)
What would you do now? Any advice greatly appreciated!! Sorry for the essay - just wanted to set the scene!!

Until you have exchanged, and without a contract you haven't, you have no rights.
Your mortgage letter may have said when funds would be available, it would not have given you a moving date. Ordering furniture was premature.
Your solicitor needs to chase their solicitor. I would suggest telling them that if a contract doesn't appear within the next 7 days you will view other properties.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. yep, i would do as above. Its strange that the seller hasnt moaned also about the delay so maybe the problem lies with them? Perhaps you could post a note through their door asking them to get in touch? If they dont then I would pull out.I love this site :beer:0

I spoke to my solicitor again today and he confirmed that we are still waiting for the lease agreement pack from the vendor's solicitors. Now I checked my correspondence and it appears that my solicitor has been waiting for this since about 13 September, so I though enough is enough.
I called the HA and told them that we were waiting for the above. Told me manager was away but someone would call me back. At 3pm I called them back and after a long long conversation (I only know what my solicitors says is outstanding) but they say that they don't do the lease agreement, their solicitors do it (HA solicitor) so I finally convinced the guy to call their solicitors to find out if they had done it. They also mentioned that according to the file, they (the HA) had answered the vendor's solicitors queries in a letter dated 25 September.
I then called the vendor and told him that had been waiting for this lease agreement pack and that it came from the HA solicitor via his solicitor and could he check the current status.
The vendor then called me back and said that his solicitor was waiting for info from the HA and their last correspondence was 25 September.
Just finishing talking to the vendor and the HA are on the other line. They have spoken to HA's solicitor and they don't do the lease agreement - the vendors solicitor does it.
So it seem that everything has just gone stale mate from the 25th of September. :mad:
And it is Friday afternoon, so nobody is terribly interested !!!0 -

Well, the story just gets juicier and juicier!!
Spoke to EA on thursday, he has recieved a fax from the vendors of the property asking for an undate (!) he sent them a snotty one back basically saying 'your not are doing naff all get your backside into gear' the secretary of the company then phoned him and gave him a right mouthfull, then she shut up as soon as EA said he had also sent the fax to HER boss, he recieved a call 20mins later stating that the contract would be sent out within 24hrs!! Amazing wat a few stern words can do!! So fingers crossed our solicitors shall have a contrat on Monday morning, all thats gotta be done then is the searchs and voila............we hope!!MSE has changed me for the better!!DD1 arrived 15/5/11, ]:money:0 -
Spoke to our Soliciors today to see if they've recieved the contract and she informed me that the other peoples 'solicitor' aren't actually acting on their behalf - ITS THE WRONG SOLICITOR!! They had changed solicitors and not told the EA or Solicitors!! Cant believe it!!! So back to the waiting game now!!!
