    I have never seen anything about people being placed in the Support Group for life. As far as I am aware they can be reviewed and move groups if necessary.

    Because your medical examiner has stated that you will be fi to work in 3/6 months, so I expect that you will have ESA until then, then if you still say you are ill, you will have another medical.

    But if that was the case then EVERYONE would be in the support group....the DM clearly thinks that whilst you may be unfit at the moment, it is not a long term thing and by placing you in the working group, you will get any support needed to get you back to work. It will also prepare you mentally for going back.

    Be grateful you don't have a long term condition which bars you from working for the rest of your life.

    Its quite common for ATOS to say a condition is expected to improve in 6 months or so.

  • Im still waiting to find out what else is available to the DM apart from both questionnaires, the one that the person claiming, and, the ATOS supposed medical representative have filled in. And without the DM actually seeing the claimant how can they make a decision.. This is really puzzling me and the people who normally jump to the defence of ATOS dont seem to want to answer??

    They can obtain evidence from your GP (or consultant or whoever is treating you).

    However, ATOS only did so in 13 percent of IB cases last stats I saw..

    They could have information from previous claims, evidence from previous tribunals, evidence from phone calls made to dwp,
    evidence from any fraud investigation should one be underway, or have been conducted in the past, evidence from yourself, cant think of anything else really.

    But I dont think they tend to look at much more than the points section, I have never had any reason to believe they even read the full ATOS report....

    The tribunal service seems to agree also that the DWP decision making is terrible.

    What other things are available to the DM?

    I do apologise for being so tardy but I only get on the internet on a Wednesday and Sunday as I havent taken broadband in my home.

    The DM's can look at evidence provided from a GP/Consultant etc. They look at the ESA50. They can look at anything provided to them by the claimant and attach the appropriate weight to it depending on where the information is coming from.

    ATOS report is heavily weighted, GP/Consultant report is less heavily weighted and, IMO, claimant providing their own evidence ie. personal viewpoint is not worth the paper it is written on.

    Most people dont provide any evidence that supports their claim to be sick other than the medical evidence they send in (Or claim to have sent in) every few weeks/months.
  • To be honest, I don't really think anybody has a clue how this system works & I'm inclined to believe that there could be a lot of scaremongering going on.

    Too many people are apparently signing themselves off IB/ESA even before they reach the medical. I'm inclined to suspect that this is more due to scaremongering than potential fraudulant claims.
