As most of the above, but I'd also get proof of postage of the letter, proving that you've contacted them to let them know of their mistake, and give them a reasonable amount of time (say 28 days) to arrange collection of the dog food at YOUR convenience. Make sure you give them your address, phone number etc...

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Thanks hairy_g

Looks like a lot of incorrect advice has been given in this forum, you can keep unsolicited goods and the company that sends them are commiting an offence if they try to charge you for them.

    Yes, by you and hairy_g.

An incorrect part of an order you have made does not constitute unsolicited goods. It's highly unlikely that the company sent out 100kg of dog food in the hope that the person buying cat food would pay for it. It's a plain mistake, and certainly isn't covered under this legislation.

I agree with cybergibbons - it is a mistake, not unsolicited goods, hence you have an obligation to contact trhe company and give them reasonable opportunity to collect the dog food.

However, as the quantity is so much, you should advise the company that you have nowhere to store it, that it is outside and will get wet if it rains. That is REASONABLE.

The delivery driver was actually wrong - he would have been obliged to take the dog food away if you refused the delivery. He just didn't want to. I would tell the pet shop about that as well - they will not be impressed by the delivery driver's actions.

A little off topic, but would this legislation apply to such things a video and book clubs who send out their book/video of the month to you and claim it is your responsibility to return if you don't want to be charged for it?

No, because you would have agreed to this when you joined, so they aren't unsolicited goods.

Anyway, I don't think any of these exist any more??

I'm putting words in the mouth of the OP, but previously I have had a large order turn up, and only parts of it have been wrong. The delivery driver doesn't have the authority or knowledge to take back part of an order.

Maybe, but in the case of wanting 2kg of cat food and being delivered 2kg of cat food and 100kg of dog food, I know what I would have done!!
