O2 changed my contract!
Comments
-
Well I just called O2. They have reduced my £35 contract to £30 and said I can call again in December and get it reduced again to £25. This is exactly what I wanted so that problem is sorted.
Problem is, I have 2 contracts with them and wanted to reduce both to £25 over time. They have reduced my second contract to £40 as a goodwill gesture and said I can reduce it once more in March 2011 to £35.
Maybe I could try to cancel the 2nd contract?0 -

Not really sure. Think it's 100 mins and unlimited txt's but not 100% sure.
A question for all of you. I have found a way to get out of my contract. Will I have to return my phone if I cancel?0 -

I found a copy of the old T&C's from when I took out the contract.5.16 If you are a Consumer Customer who has selected a tariff with a Minimum Period, you may not move to a tariff which offers a lower rate monthly subscription for the first 9 months of your Minimum Period. After 9 months, you may only move down one tariff, per month, to the next lower priced tariff unless you pay us the difference between the monthly subscription on your original tariff and the lower rate tariff we agree that you may move to. Where you have notified us you wish to move to the next lower tariff, unless we advise otherwise, your new tariff we commence at the start of your next billing cycle.
This is the revised new section from October.5.16 If you are a Consumer Customer who has selected a tariff with a Minimum Period, you may only move to the next available lower priced tariff which offers a lower rate monthly subscription:
(a) once during your Minimum Period; and
(b) after you are more than halfway through your Minimum Period. Subject to paragraphs 5.16 (a) and (b), you may only move down one tariff, to the next lower priced tariff unless you pay us the difference between the monthly subscription on your original tariff and the lower rate tariff we agree that you may move to. Where you have notified us you wish to move to the next lower tariff, unless we advise otherwise, your new tariff will commence at the start of your next billing cycle.
Here is section 8.4 of the T&Cs...8.4 You may end this Agreement by giving us written notice if:
(a) we break this Agreement in any material way and we do not correct the situation within 7 days of receipt of your written request;
(b) we go into liquidation or a Receiver is appointed over our assets; or
(c) you are a Consumer Customer and we increase charges by more than 10% for calls, messages or data that form part of your inclusive allowance or your Line Rental Charges or change this Agreement to your significant disadvantage in accordance with paragraph 9.2 of the General Terms, provided you give us a minimum of 30 days’ written notice (and provided you notify us within one month of our telling you about the changes). This does not apply where:
(i) the increase or change relates solely to Additional Services in which case you may cancel, or stop using, that Additional Service;
(ii) the increase does not exceed any relevant indices, including but not limited to the Retail Price Index (“RPI”) or the Consumer Price Index (“CPI”) figure in any twelve month period; or
(iii) the increase or change is as a result of a requirement by a government or competent regulatory body. For the avoidance of doubt this shall include any increase in VAT or the imposition of a similar or new tax on the Service or us.9.2 If we increase the Charges for the elements of the Service you are using or change the terms and conditions of this Agreement to your significant disadvantage (in our reasonable opinion) we will give you 30 days' notice in writing before the changes take place. We will notify you as detailed in paragraph 7 above or we may notify you by text (SMS) to your Mobile Phone number and/or by email where you have supplied your email address to us for this purpose.
They didn't inform me within 30 days about the changes which I believe have significant disadvantage to me, therefore they have broken the T&Cs and I have the right to end the agreement. I think?0 -
you can try for that they could say they did inform you though you got to prove they didntWhat goes around-comes around0

Even if they say they did inform me, I can use paragraph 8.4, section c, to break free.0

I would tell them that you intend to evoke that clause and quote the t&c you found. You could ring first, but get the confirmation of your cancellation of the contract in writing.
You will lose your numbers, of course.
If you want to keep them, then you should threaten to cancel unless they revert back for both of your contracts.0 -

I started on the £35 600 min 600 txt unlimited net iPhone tarrif
Upped it to £45 as needed 1200 mins for a few months
Called yesterday to reduce it and was told that your original tarrif no longer exists and your data if you go back to £35 a month will be capped at 500mb.
Pointed out that as I was not notified of these changes to my original contract that they are in breach of the unfair terms in consumer contracts act (cant remember exactly which bit I quoted off hand) and they are
"getting back to me"
i would ask for it to be escalated to a manager when you call them again.
You were not notified of the changes as the changes dont effect your current contract. (£45 a month) will remain on unlimited data for the rest of the term.
As all they have said the original £35 a month contract (with unlimited data) doesnt exist any more. And you have to accept the newer capped contract if you want to lower down to £35 a month.0 -
SUCCESS! Called O2 Retentions and told them that they have broken the T&Cs and I therefore am within my right to end the agreement. They wanted me to stay obviously, so they are now going to honour paragraph 5.16 of the old T&Cs! :j0
