What would you have done if she had told you there would be a new model, and then it never happened? If you wanted a good camera, there are much better (and cheaper) phones available.

Personally I find its better to invest in a small handbag sized Kodak for on the spot photography anyway as it gives you more choice (and infinitely better Megapixels), but I am a woman so can stash it in my bag and I'm also a photographer. The only time I use my 3GS Camera is really to play around with hipstamatic apps etc

Before upgrading to my iphone 3GS I specifically asked the girl on the phone will there be a newer updated iphone coming out in the summer (as Apple always tend to bring out their new products in the summer June/ July or August), this woman reassured me that a new phone was not coming out this year so I agreed to upgrade my phone.

There is no way on earth I would have upgraded then knowing I would be stuck with an out of date iphone for the next two years, I feel I have been mis-sold the iphone. Luckily I was informed that the phone call will be recorded for training purposes so you go back and check my story out.

I knew the iphone 3GS didn’t have a good camera/ videoing capabilities so again would never have agreed to sign up knowing this would be improved with the new iphone 4. I have a 1 year old and do use the camera & videoing quite a lot (even though it’s not great).

Have I got a case to moan about being mis-sold the iPhone 3GS when I specifically asked or said I'd wait for a newer iPhone 4 ?

When did you buy the iphone 3GS ???

I have a 3GS and I won't be upgrading to the iPhone 4, I installed OS4 onto it so the software is the same as the 4. Therefore the only really difference is the Camera / Video.

If the camera is the most important thing, than you'd be best buying a Digital Camera you can get one for under £100 which will beat any camera phone going.

I can't see an grounds for mis-selling, anyone who reads the net knew in spring that the iPhone was coming in the summer, just like there is now of iPhone 5 in the summer of 2011.

I don't believe you have any comeback. All mobile phones become 'out of date' very quickly. If you choose to wait, you will never get a new phone, as there's always something else around the corner.

Unless the network has specific release dates on their system, anything else will be based on rumour. It doesn't matter if it's been announced by Apple, each network has their own release schedule.

There's enough resources on here and other sites to do your research getting the best deal you can at the time.

I'm with the OP on this one, I'll be on the phone to Orange once I've shouted at BM for selling me a car which they went on to facelift, and Redrow, for selling me a flat, and then building bigger ones. Oh, hang on...

Tried a couple times but no joy, said it would cost £700 to upgrade (like anyone is going to pay £700 just to upgrade).

    Cheers

you cant get out of a contract because a new phone has come out even a day later its up to you to do the research

and the 700 charge is prob the extra handset cost plus your remaning monthly contract fee
    What goes around-comes around
