Depends on what you mean by business as usual for me! Yes it is via F.O.S but no its not with the banks and credit card firms (except santander) I'm receiving the "hold" letters from all the banks on all cases!( they are blanket holding everything regardless of whether or not its criteria falls under the judicial review) which gives each case the automatic ticket to go to F.O.S, whereas before i would receive offer letters!
Now comes the whooping great 15 page complaints questionnaire and complaint doc for each case! that you must send to the client to fill in then send back to me to check and then send back to F.O.S and wait 3-6 months for a decision, that then sometimes gets ignored by the bank and you can then have a 2 year wait for an actual ombudsman to review the case!!! so sort of business as usual! lol

I spoke to the press office at the bba yesterday and told them that a halifax employee told me on the phone "nothing new is being looked into, everything is on hold" he just said oh! thats a regulatory matter! The banks are even ignoring the bba's guidance on this matter, that on top of the fsa and fos being ignored! No wonder why i'm anxious about justice prevailing?

Sorry, but this is not correct, as i stated above, i only submitted a new claim just over a fortnight ago, and my sister-in-law has recvd her offer/refund already.

Be happy to have that name and number, you can PM.

I suspect different employees will say different things, as they don't actually know.

Bottom line is they can only hold pre-icob as per the court app.

spoke to somebody and they agreed that it was only pre 2005 as per the JR papers... otherwise it would be an illegal hold by the banks

you run a CMC? is this not quite easy?

pitch 4 or 5 other CMCs and begin some kind of legal action against the banks for holding claims unaffected by the JR

    skin them for more money.

Good idea! im up for it! what about you thebigdog?? maybe they will buy us all out for damage limitation reasons, it would be cheaper for them!

look i'm not on this forum talking crap and spinning lies! i know what the halifax lady and then a man said to me! All i want is the banks brought to justice and for people to get there money back! CMC'S only exist because of the banks un-helpfulness, delaying and putting off tactics! I'm not a money grabbing faceless company, i'm a one man band who himself claimed back my bank charges, credit card charges and my own ppi! i started helping my mates get refunds for free and got told that i should start charging for my time, now im a massive pain in the banks butt! i have also just made a deal with a very famous london firm to recover all there 6000 staff members various charges/insurances etc. so i will fast become a major pain to all financial houses soon! So i hope all goes well for everybody, i want to make them all happy with a refund!

And what are you going to do that FOS and the FSA cannot do? FOS are still accepting complaints and business as usual regardless of what the banks are doing??? Why could you actually get money quicker than they can by using the courts? Your arguments would only be the same as FOS and I would say FOS will still uphold even complaints whereby the Banks have them supposedly on hold. It will just be a matter then of the consumer "making" the bank pay out surely via the courts!!

Consumers very rarely like to go to a court alone... maybe the mysteriously silent Mr Lewis and co could advise us consumers on our next move?

Be a month since the BBA action tommorow... and not a peep

    Pete,

I'm happy to look at anything that would make the banks start dealing with complaints again, but I think it might be unwise to start any form of legal action at the moment becuase all the balls are in the air and nobody can predict how they're going to fall. I also think that the FSA have got to step in shortly to rectify whats going on anyway. Until things come a bit clearer, I think any form of legal action isn't going to produce very much.

    TBD.
