ive had a massive fall out with my kids dad, and as a result he has stopped paying me direct maintenance...hes taken his parents advice and gone through the csa so he only has to pay the minimal amount, he was payin me 500 per month for 2 children. the csa have came back to me and said he only has to pay 39 per week for both children based on his wages......im mega stugling, anyone been in the same position#?...think ex's are just out to cause problems when its the kiddies that miss out.....

Omg!!! You were lucky to be getting 500 per month, if the assessment says 39 per week then thats all you are gonna get im afraid.0
-
I am sorry to say that is your lot, if the system comes up with 39 a week get used to it!0
-
is he self employed by any chance?0
-
 £250 per child every month, bet he's glad he went via the CSA and got it knocked down to £39 per week. He isn't paying the minimum he is paying what the law states he must pay, not a penny less or a penny more.
Just remember you get the child benefit, you get the child tax credits, you get the working tax credits, he gets nothing.*SIGH*

Nuff said :beer:0 -
you were incredibly lucky to get that amount in the first place. Did you suspect he was paying over what he was supposed to be providing? If so, not a good idea to have a raw with him. In the end, he has done what he was entitled to do and there isn't anything you can do about it, unless indeed he is self-employed and suspect he lied about his revenue.0

Stacy....get a job.0
-
yes he is self employed, and that is wat i excpected him to do, i have appealed and the case will go to appeal on the evidence i have given them, hes a silly man as our accounts were up untill recently joint and his income at the time of lying to the csa is very clear! and yes i do have a job thank you very much, i work full time and i am a full time mum!0
-
Please remember that as self employed accounts can show a very different side to what it actually is. As you say until recently you had joint accounts, fine but in this day and age all of us have hit hard times, if his accountant is any good he will be able to put together a set of accounts that will show that he has very little income, they do it for the Tax man most of the time anyway!
Please don't go off on one if the Appeal upholds the CSA assessment and then take the attitude that he wont see the kids. There is no pay to play law in this country nd contact is not directly linked to payments and the Courts take a very hard line on anyone that tries this route.
Hope this helps.0 -
Of course contact shouldn't change because of it, it makes no direct difference to the kids whether he is lying or not, the children won't feel they want to see any less of their dad, pity though that he didn't take this view himself and didn't realise that having a raw with their mother doesn't justify making them pay for it by cutting down THEIR money.0
