Thank you - I know it is - I am caught up in the middle of it all!!

Worried sick that they will kick me off JSA if they found out about my problems. Can't tell them the problems so treated as a 'normal' JSA claimant - fit to do any work

No wonder you've been told to find a job working 30 hours week then.
Nobody seems to want to take responsibility for me!!!

You wouldn't have this problem if you went on to PC.

Do I have to repeat myself again????

Yes I know why they have got me down as a 'normal' JSA claimant - what I want to know is why will I be kicked off JSA if I was to be honest with them and tell all about by health problems?
I know the answer! Because they would see that with my illnesses/disabilities they would decide that I could never be seen as ABLE to work full time.
Then I go back onto ESA to claim for the same illness that I failed to convince them 10 months ago that I was unfit for work.
I don't want to go onto ESA, unless I get into the 'Work Group'!! That is only when I will be offered the help I need. Some chance on that happening.

Pension Credit? Yes of course, but what will they do for me? I don't want Pension Credit!!

For ****s sake all I want is some help either with JSA (to take into account my shortcomings) or ESA (Work Group) - to help me get back into a working environment earning even a small wage.
Is that too much to ask for??

"That would be assuming the same tests and criteria applied to both ESA and JSA.

It does not, therefore it is quite possible to be fit for work under ESA and unfit to claim JSA".

I was allowed to claim JSA with the following problems - I'm deaf, and can't use a phone, or talk unless I can Lip Read, I have asthma which makes it really hard to breathe, I can't do heavy lifting or walk for long periods of time, I have depression (to the point where I have attempted suicide before), I was also in a car crash that damaged my spine and leaves me almost always in pain. I claimed JSA for 18 months and was given a disability advisor who helped me find a job that was right for me (been working for 4 months now)

Telling them you have problems wont make them take JSA off you, showing them a sick note signing you off will. Tell them without showing them the note and they will allow you to limit the type of work you can do and probably give you an specialist advisor who can help you. I was allowed to look for part time work (around 24 hours a week) working a maximum of 4 days a week. I was also allowed to limit my hours to between 2pm and 11pm.

Stop being scared of them and tell them what they need to know to give you the help you need.

Exactly. Pretty much what I did.

  • Your inability to detect sarcasm is quite amusing - that was exactly my point - you were quite happy to recieve ESA without any JCP support to return to work until you were booted off it by failing the WCA.

To my mind the fact that you chose not to appeal it is fairly irrelevant - you don't receive conts based ESA at the appeal rate as you well know so the only reason you are claiming JSA is that's the only benefit income you will get and this will run out once you're six months have elapsed in any event.

You have sufficent income to not get very much from pension credit which suggests you are in a much better financial position than the majority of people who are unemployed, slightly younger than you and claiming income based benefit - that incase you didn't realise if the government defined poverty line.

The only person that can truly help you get back into work is yourself - the very limited help on offer from JCP is neither here nor there really and as you have pointed out yourself is tailored to getting you a job that you don't think your health is up to! You hardly need to claim a benefit to get yourself back in a position to find a job now do you?

I will not waste my time answering your pointless post.

    No it isn't. Not legitimately.

Thanks for that at least that has got me thinking.
It's a bit deceptive, but I can see where you are coming from.
What they don't know about certainly won't hurt them.

Right I will do as you say and make an appointment to see someone. Tell them as it is - the good and the bad! But keeping the certificate at home or firmly in my pocket!

Hopefully I will see someone over the next couple of days.

    Here's hoping

    Thanks

    Please explain?

Experience has told me that that is what happens in reality.

I know what happened to me in January.

Anyhow politics aside, I have now decided to go to the JC this week and tell all making sure that my certificate stays firmly 'locked' away.

We will see what happens and report back asap.

You can't be found both fit and unfit for work. A JSA DM would bow to the superior expertise of an ESA DM.

    Hah!!

    hierarchy within the DWP!!

So the DM for ESA holds more sway than the DM for JSA.

    You learn something new everyday

    Thanks
