Even if the previous occupier has appealed you still have the right to appeal, however if the previous occupier appealed and it was confirmed as being correct by the tribunal then it is unlikely that your band will be reduced unless there has been a material change of circumstances.0

When we movbed into our property in 2002 we were re-banded to Band C based on a purchase price of £46,000 (which was band C in 1991).
As such we are the only flat on this street that pays band C with all the rest in Band B. No other flat has been re-banded since in 1995 in this street despite many being sold in that time.
Im guessing this gives us strong grounds for an appeal and claim for a refund.

I have just written my letter and will be posting it tomorrow. I believe I should be lowered atleast one band but possibly 2 bands to Band A.

hey Leni, im very dubious of all the price index calculaters as in MOST areas property values were lower in the mid-nineties than they were in the early nineties - this never seems to work out in the index process though.0 -
you are right to be dubious of them, they are there as a Guide only, as they cover a huge area and take an average only. Open Market sales is the best evidence, and it will be the evidence the VOA will use to check your bandings.0

If you believe your house is in the incorrect band you can still appeal if you have been living there for less than six months or request a review band if you have been living there over 6 months. But i would suggest that you have some good evidence to support the reason why you think you are in the wrong band, and why it should be lowered as if it is found to be too low they can put the band up.0 -

I Have a Question can any one answer this, If I have moved from a property that I have been paying to much tax on is it posible to claim back that tax for the error that was made0

Forgive me if tis has already been covered but where is all the money for the rebates coming from, sure as eggs are eggs we are all going to see an increase in council tax next year to pay for this!0

You cant appeal against the banding as you are no longer an interested party but if you contact the council you may be able to claim back tax if the property has since had its banding lowered0
