  • This is greatly appreciated thank you! I don't know the name of the park owners unfortunately but a good letter anyway!

That looks a good letter to me. Only query did you enter your registration correctly in the machine? These tickets are issued automatically by an ANPR system and if you slip up with your car number causes the issue of the ticket.

By the way, send the letter to "Accounts Department" and don't put a stamp on it. When they have paid to get it only to be told where to go, hopefully they will not think it worth having any more goes at you!
  • Yes I did enter my car details correctly. I'm surprised the fine was generated!

It isn't a 'fine' of course. We are not at all surprised.

These companies just 'farm' car parks to make money for any old reason out of unsupecting drivers. They may as well just get someone to take down car reg numbers like a train-spotter in a little book then issue fake PCNs to all of them.

There's no rhyme or reason to it - because the whole agenda of a PPC is to make as much money as possible. Nothing to do with car park 'management' or any service whatsoever.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hi everyone (this is my first time posting)

I'm pleased I found this. I have received a 'fine' back in October from Parking Eye, I wrote to them advising them that I was no longer the keeper of the vehicle (the car had been sold two weeks prior to the 'offence'). I sent it recorded delivery addressed to their appeals dept (now learned thats a waste of time!)

And then three days later I received a SECOND letter with a new 'offence' so I re-worded and printed my appeal letter again and sent it recorded delivery to the appeals department.

TOday I haev received a letter chasing up saying that they have satisfied sche 4 and as a result they have the right to recover any unpaid part of the charge from me. (So I'm expecting another one in a couple of days for the second 'offence')

I have my notification letter from the DVLA telling me I'm not the keeper so why are parking eye insisting that I am - I've rang DVLA who have told me that their screens show I'm not the keeper!!!!!

I am so worried that this could affect my credit etc because I am in the middle of setting up my own business which will require loans etc. I'm also generally a panicky person.

I'm happy for it to go to court as my hubby is a solicitor and I'll let him deal with it but I'm still worrying so much :-( I didn't sleep for a week after receiving the first letter. I was in tears last time I rang DVLA - feel really upset writing this :-(

You have found your way to this forum.

You can see lots of threads with people who actually DID park in private car parks, got a ticket/invoice and have all been advised to ignore the bullies.

Now you have proof that you sold the car, that you are not the Registered Keeper, didn't park it there and your hubby is a solicitor. You are in even a better position that 99% of the others who have all been advised to ignore the PPC.

So what are you worried about??????? What additional advice or guidance do you need?

If you feel you MUST do something, then write back to them advising them that the DVLA information they received was not up to date and that you are not the Registered Keeper of the vehicle. Get hubby to pad it out in legalese if you like, but there is absolutely nothing to add that hasn't been said a thousand times before on here.

So forget it, and have a great Christmas.

What area of law does your husband cover? He must have done contract law in becoming a solicitor surely? The only way this could effect your credit history is if it went to the small claims, you lost and didn't pay the judgement within 28 days. So how can it succeed when you didn't own the vehicle? You have a letter from the dvla saying this, that is the end of the matter.

  • Ok, after reading this I feel so stupid. I paid the £50 charge on 20th of this month because I was worried I'd get the larger fine if I didn't. I thought it was a bit odd that I received no reply to my appeal or my strongly worded emails and there was no phone number, but had no idea it was this bad. Is there anything I can do to get this money back because I paid on a credit card? Where do I even start about attempting to sue them??

    Thanks,

    Liz

You may be able to instruct your credit card company to perform a 'chargeback'. There have been widely different experiences with this with different companies, generally more applicable to clamping fees though on the grounds that they were 'disputed payments made under duress'. The favourite seems to be Barclaycard and it's Indian call centres who are happy to do as they're told (the UK ones are supposedly useless).

Note 'instruct'; not 'ask'. You must instruct your credit card company to perform the chargeback.
