    Hi All,

    Like many of you, I seem to be having a run in with these monkey's . . problem is I am not about to go way . . . they have decided they wish to go to war and that suits me down to the ground (or should I say my solicitor).

    I have told them in no uncertain manner that they have two chances of getting me to pay them, none and even less.

    This is a company who pray on the vulnerable and if you are naive to believe the rubbish they send, then yes, I suppose you could be intimidated into paying.

    Mine is no longer a case of wait until they process through the County Court but process myself . . my claim in compensation inclusive of my solicitors costs (which run out at £350 per hour) which by the time he is done with them they are going to see his costs in excess of £3500 . . . plus compensation for their unprofessional harassment and intimidation is going to put the hairs up on their backs..

    Also, you need all to check with trading standards, their signage is not in the appropriates size and the verbiage on the signs does have an adverse effect on ones statutory rights, therefore its no more then very hard toilet paper.

    In short, rip their throats out using the judiciary and make money out of them and not them you.

    I may have misunderstood your post cpulsak but from what I can gather, is that rather than waiting for them to take you to court for non payment you are in fact taking them to court for harrassment and intimidation? If so, please keep this thread updated. Looking forward to a happy ending for you x

  • Ok, after reading this I feel so stupid. I paid the £50 charge on 20th of this month because I was worried I'd get the larger fine if I didn't. I thought it was a bit odd that I received no reply to my appeal or my strongly worded emails and there was no phone number, but had no idea it was this bad. Is there anything I can do to get this money back because I paid on a credit card? Where do I even start about attempting to sue them??

    As you have paid it is best to put it down to experience - the experience being that now you know to ignore them if there is ever a next time.

    It wasn't a fine, it was an invoice.
  • I've just received a parking fine from Parking Eye asking for £80 (£50 if I pay before 24 May), however there is one floor in the issue of this Notice - I paid for a ticket on my car and displayed it, it was covered for the period they have fined me for apart from the 2 hours free parking which the sign stated when I arrived (I didn't realise I was going to park as long as I did)!!! I paid for the ticket 1 minute before the 2 hours free time was up - I kept the ticket too! I was impressed with the up-to-date machines they had in the car park which asked you to put in you registration number, however if these machines can't even tell the people who issue the parking fines that I'd paid for a ticket in time they were fining me for then they are no more use than a chocolate fire guard!
    My question is do I waste my time writing a letter in the hope of waiting for them to decline my appeal knowing that have proof that my time in the car park was covered? This won't go against any credit ratings if I don't pay will it? How come they don't give you a number to ring to dispute it??!?!

    There is no appeals process so forget that.

    No, they cannot affect your credit rating.

    You have two choices, as I see it.

    1. You ignore everything they send you. Warning, some of it will be scary - debt collectors, solicitors, threats of court action, allsorts. All of it utter tosh. Eventually they will give up and go away.

    2. You could write to them, enclose a copy of the pay and display ticket, and TELL them to stop bothering you, or you will contemplate legal action in accordance with the Protection from Harassment Act. Then, if they continue to send the begging letters, actually submit a small claim against them and the car park owners for harassment.

    If you plump for 2, do not send anything until we help you with the wording of the letter!! We can also help you with the subsequent claim!

    Whatever you do, DO NOT PAY, and DO NOT CONTACT THEM (other than sending my suggested letter above).

    To the one who paid, get ready they will be back for more money, they will claim you paid late.
    They are scammers and like all scammers they keep coming back.

  • ManxRed thanks for your speedy response! I will opt for option 2 as I do not relish the idea of receiving threatening letters. If you could help me to draft the letter it would be much appreciated. As for the subsequent claim it would be nice to think I could make them squirm instead of them ripping people off! It's frightening to think how many people actually pay these fines and the fact that the amount they make probably outweighs the amount they are ever taken to court for! The great thing is is that the i kept the ticket which I don't normally do!

    Dear Sir/Madam,

    As registered keeper of car registration XXX YYYY, I have received an invoice from you in respect of breach of terms and conditions of a parking contract formed between yourselves and the driver of the said vehicle. This was related to an incident where the vehicle was parked in (name of car park) on XXth of YYYY 2012.

    As you can see from the enclosed copy, a ticket was purchased and displayed covering this period, and therefore the driver has not breached your contract and therefore no monies are due to you as a result. In any event, the sum you have requested constitutes a contractual penalty, which as I am sure you are aware, is unenforceable under Civil Law.

    I would ask that you now cancel this invoice. Any further correspondence received from you or your agents relating to this incident, other than to confirm the cancellation of the invoice, will be treated as harassment, and legal action may be taken against both you and XXXXXXX [see comment below] who I will hold jointly and severally liable, in accordance with the Protection From Harassment Act 1997.

    Re: the name of the second party, do you know who owns or operates the car park? If this is a reputable company who has mistakenly hired these scam artists to manage their parking, they will not relish being dragged into possible legal action, and it may just stir things up further for Parking Eye.

    Also, other might have some suggestions on my letter draft above so give it a while to see if anyone else comments.
