Debt not listed in bankruptcy??

    Yeah, that is what I think is odd, it is either a mistake that is says settled or the fact it says settled relates to the fact that they sold it on and they have had their money from the DCA??

    That is most likely to be the explanation.

    When a debt is sold on, if the DCA wants to take over the reporting of the account to the credit reference agencies, then they must have the entry switched over to the DCAs name.

    But, if for whatever reason the DCA doesn't want to take that over, the entry must stay as the original creditor stating that the debt with them is settled.

    Hi everybody, I have sent my letter off and it was signed for yesterday, Go-debt have sent a card to me now asking why I am not co-operating with them - and that they are sending an agent who will arrive up until 9pm in the evening or at the weekend. I know that at the time they sent the card they hadn't received my letter but I am getting sick of this now - any idea what I can do??

    personally, i wouldn't open the door to them IF they even bother sending anyone out - often it is an empty threat to get you to call them. please don't bow to their pressure. ignore the door, you have written to them

    They (go debt) have just called and my wife answered, they were acknowledging my letter, my wife said they should do so in writing but the lady (who was unusually friendly on the phone) asked if I would call her to go through the contents of my letter and then they will confirm it in writing etc - any idea what this is all about?? should I call them???

    I wouldn't waste your money calling them.......you've done everything you should, just ignore them now Bollie or remind them of the letter and you will take legal action against them if they continue to contact you x
    A formal complaint will be submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

    Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

    Ok so if I do call them to find out what she will say, am I opening it all up again? or can I call and just refer them to that paragraph in the letter???

    as If says, i would stick to dealing in writing. if you do it over the phone you have no proof of conversations. next time they call just say you will only deal in writing and end the call

    The only reason I can think that they want you to call them, is so that they can try to spin you some bollux about the debt not being covered, in the hope that you can still be mislead/conned.

    You have set out the position in writing.

    There isn't any doubt whatsoever about the legal position.
