Sounds like you've got it sorted, but my response on PePiPoo was:
Step 1: Don't panic.
Step 2: Get the exact details yourself: http://www.trustonline.org.uk/
Step 3: Apply to get the judgment set aside using form N244: http://www.hmcourts-service.gov.uk/HMCSCou...rt_forms_id=484 This will cost £75, which you can ask to get back at the end of the process.
Step 4: The hearing to get the judgement set aside due to no court papers being received (quick 5 minute meeting in court). Ask to have your £75 back should you win.
Step 5: Contact the credit agencies, mortgage co etc: http://www.insolvencyhelpline.co.uk/ccj-re...ence-agency.php
Then you can go about sorting your mortgage.
Step 6: The case will start from scratch and you will receive the original court papers to defend, which we'll help you with. Assuming the parking company want to bother - they were probably hoping to get an undefended judgement by default anyway.0 -
i have written a letter to the court asking for a copy of my case details with the £5 fine. i can then fill in the N244 form. just have to wait now... really appreciated once again for all advice.....0

Hello again- I just had a look on pepipoo, a member posted that I should never contact the debt collection agency or their solicitor....
why is this? I had to call their solicitor to try and find out about my claim. One of the staff there (i assume a solicitor) left a message on my voicemail today that I should call them back and that although they were no longer working for the DCA, they could suggest some ways to sort things out? This was the only number I had- the court gave it to me. I still dont know who the DCA actually is.
should I igore them now and just proceed with my getting the ccj 'set aside'? Or listen to what they have to say? I already called them back earlier and left a message to call me bck before i saw on pepipoo that post not to.... help!!!?0 -
Sort it out means how we can get the money off you. Get the ccj set aside as the solicitor will just want you to pay and you'll still have to sort out the ccj.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

thanks, i'll ignore any further calls then....0

They are only interested in getting the money.
Definitely do not contact them or divulge any details to them.
(Presumably you haven't yet submitted your application to set aside your ccj, and if they find out your new address they could still enforce their judgement by way of getting a court order - "warrant of execution" - which could mean bailiffs calling. Also anything you innocently say to them could be used by them to try and stop the ccj getting set aside)0 -
Just to sign off-
Many Thanks for all of your messages and help/advice. Much appreciated when I didnt know where to turn. I ended up contacting citizens advice bureau who sent me to Croydon and Sutton Law Centre (CR0 1JG) where you can get free, one off legal advice. They were massively helpful- I would recommend to others. I have now settled this out of court. Although it leaves a bitter taste in my mouth to have paid those b*****s anything. Im glad its over, can rest easy egain.0 -
"I have now settled this out of court. Although it leaves a bitter taste in my mouth to have paid those b*****s anything."
Which suggests the Law Centre were useless.
There was no need for you to pay a bean. As Alexis stated - you get the Judgement set aside and you are then back to square one with the PPC trying to get money from you, but you in a position to prepare a solid defence.0 -
As Davy says you did not need to pay a thing, they just bullied you into submission, it just shows how low they go and how bad solicitors are often in parking incidents. Well at least its all over now.
Best of luck for the future and come back if you have any further problems.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0
