Big Bailliff issue - threatening to remove items without my attendance

  • Hi affluenza - I don't know why you seem to have attracted some of the less sympathetic posters but the majority of people are normally quite helpful.
    I hope you can sort things out with the bailiffs.
    I just wondered if you could go bankrupt before 1st December , or is that the earliest you can get the fees together? If it's just waiting on an appointment perhaps you can phone the court and see if there have been any cancellations or anything?
    I agree with Hallowwitch who said get in touch with the council and find out why they have not contacted you in the interim and why they never contacted you at the time and why they find it necessary to employ bailiffs on such a case - check that it is correctly calculated - ie you were receiving the single person discount if applicable (you might find this really difficult to prove retrospectively but if you have any proof of letters you sent them etc this would help), the dates are correct etc.

    hi, Hope somebody can help..I moved house on 22nd August 2010, I had some council tax arrears on my old address, they were from 22nd March to the 2nd August. I received a bill from the council which I couldn't afford to pay, and then later a notice saying that they had handed over my debt to rossendales bailiff for collection. The problem is they have billed me up until March 2011! I'm not responsible for all if this as I moved in August. I emailed the council on the 23rd of September telling them this and giving them the address of the person who is responsible for the bill fro the 2nd August to March 2011, they didn't get back to me! Then on the 30th September i got a visit from rossendales demanding £657 from me, saying that they would accept instalments if I paid them £130 immediately. I didn't let them in the house, and I told them that i'm not liable for all of this bill, I was told by the bailiff to inform the council as they won't stop pursuing the debt without them telling them not to. I feel really annoyed that the council didn't get back to me when I contacted them on the 23rd as if they had the bailiff may never have been out to my home. I'm so worried, really hope someone can help.
  • I've had problems with Councils in the past, they won't always respond to queries or complaints and will often pass bills to debt collectors very quickly.

    I got some sorted out very quickly via an official complaint to the Local Government Ombudsman - they're the body that oversees local councils and their behaviour: http://www.lgo.org.uk/

    I found them very helpful, and as soon as they get involved, the council will fall over themselves to rectify the situation. (In my experience)
