Big Bailliff issue - threatening to remove items without my attendance
Comments
-
wish i had noticed this yesterday
A bailiff collecting council tax CANNOT break into your home
they can only gain entry by peaceful means through an unlocked door or open window
even a bailiff that has been in a property before and Levy distress must inform the debtor by letter giving the time and date of re-enter to a property
bailiffs don't want your goods its to much hassle for them what they want is the levy fee walking possession fee and the van/attendance fee
a bailiff uses a levy on goods to increase there fee and intimidate the debtor with threat of removal
don't park your car outside your house as the bailiff will levy on it don't let them into your house don't open the door to them and deal with the council if the council refuse to deal with you and the council tax is this years pay it on-line
As long the bailiff doesn't get a levy you will be OK and bailiffs fee will be no more than £42.50I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites
If you are in any doubt please seek legal/expert advice help0 -
They haven't levied anything to my knowledge and there has been absolutely NO information on what goods they identified.
I had to go to work and I pinned an envelope on the door for their attention - in there is a letter that has also been sent recorded delivery which basically indicates that I require the vehicle for business and that any other items business items such as computers are required for me to carry out my work. I pointed out that removal of these goods would be against their code of conduct.
I haven't refused to pay them but at no point have they given me a list of their fees or my rights. I have said that I will pay via installments once we have the full figure and if an installment plan is not acceptable to them then to pass it back to the original creditor.
I have also pointed out that further visits calls etc will be deemed harrassment.
I got a template from another site and amended it.
Naturally should they go down the lawless route then they become fair game and I may be pushed to declaring BR sooner, in fact if I had the money I would do it just to damn them.
I took my items and if they did break in - good luck to them - it is a tip.0 -
            Oh darling
How are you? Silly question. Did they come back today?

Well I worked late, dreaded coming home - move car to private garage and there is a guy in a car in the carpark opposite looks like he is watching me. So I grab a torch and shine it at him, and shout what is he watching exactly.
Because I'd seen him act odd before - any way turns out he is neighbour and Polish.
I go to my flat and the letter is still pinned to the door, nothing through the letterbox, no forced door, nothing!
I was fully expecting to see damage - but I am going to decant my most important things so I keep them near to me.
Thanks for your well wishes.0 -
Have you contacted the council and asked them to set up an attatchment of earnings? This basically means a set amount will be deducted from your pay before you receive it and paid directly to the council. I believe (although I stand to be corrected) this would stop any bailiff action as you have agreed to make payments.
Hope this helps. Good luckOfficially BR at 2.10pm on 6th May 2009, ED 7th December 2009

            Dear MoneySavers....
This is a difficult board - many think bankruptcy too easy - and I dare say in some cases it is. Yet others have been through hell, seen family and home torn apart, and its a welcome and deserved release.
I didn't set up MSE to be personally judgemental, but to help people whatever their circumstances. If you have problems with the Bankruptcy laws then the 'Discussion Time' forum is the appropriate place.
This is to help people who are bankrupt rehabilitate their finances - and I personally wish them all the best - whatever their circumstances.
Many people who have gone bankrupt, have had serious debts, have hidden them for a time, been scared to confront them, suffered depression or have even had suicidal thoughts because of them.
So may I caution MoneySavers to err on the side of kindness. The fact bankrupts are here means they're looking for help, guidance and to take charge of their finances - and that in itself is admirable
Please use your knowledge and kindness to help rather than to berate.
If you feel it’s important to point something out that the poster may find negative but needs to understand, then it's not a problem, but do think carefully about your phrasing - people can be very sensitive and nuances may mislead when it’s in an online Forum.
