Big Bailliff issue - threatening to remove items without my attendance

Have just come home to this:
BALILIFF REMOVAL
Payment due in 24 Hours
I have attended today with the intention of removing goods and chattels as re necessary to discharge the outstanding Council Tax Liability Order and any Enforcement Costs incurred.
PLEASE NOTE - No further arrangements are acceptable and payment is now required in full by CLEAR FUNDS ONLY.
I will re-attend at your address with immediate effect and may REMOVE goods even in your absence. Should you wish to avoid this distressing course of action, contact me on the telephone number below to arrange prompt payment of your debt.
No contact will be taken as your refusal to pay.
Admission time, I have not contacted them, quite simply because I have had zero cash available and what was the point.
Their last letter said they had identified goods - interesting as they have never set foot in my property nor have they ever been invited in - my door entry system does NOT work. I live in a block of flats - my threshold is my door frame not the communal area.
Can someone please confirm that they are NOT permitted to break in.
I need to go to work tomorrow and I am on my own without anyone to guard the place.
Maybe I have brought it on myself but I need some advice please.
I am trying to go bankrupt in December - I just don't have enough to do it now - not without totally getting into the brown and stickier - should I tell them I am going BR? I should imagine that will make it even worse.
Thanks

            Hello - thanks for that.
They have never actually crossed the threshold of my flat nor have they had any signature from me.
I have not communicated at all with them, and I am only willing to pay the original creditor but I don't have any payment card.
The council were unwilling to retract the bailiff, and told me to deal with them but quite frankly I don't want to deal with bullies - which fair enough is what they are paid to do.
I am willing to make payment to the council directly however I am unclear as to whether to advise them that I will need to go BR and how it will affect the situation.
OK I am willing to lose my car in BR if deemed necessary but not preBR to bailiffs as I need it for work as I work at multiple sites.
I have tons of junk which I can't even sell on Ebay - don't know whether I should stick a couple of boxes outside the door and just give them that.
They don't even have a walking possession order let alone a signed one!
I should be packing a bag and taking whatever valuables (sentimental) I have away - should I put my old bed out? give them something to take?0 -
i'm so sorry i really don't know what to suggest...i hope someone will be along soon to help x0

Bailiffs work purely on FEAR and they actually can do very little if you refuse to let them in. Bailiffs are VERY cunning and will try and trick you into letting them in as they know that once you have let them in JUST ONCE they can then legally FORCE entry at a later date.
The simple answer: NEVER let a bailiff in UNDER ANY CIRCUMSTANCES.0 -
Hello, I don't intend let them in - my concern is that they can break in. The way it has been written suggest that he can. I will be talking to the council tomorrow to ask them to take back the case because I can't deal with that level of aggression.
I am wondering what they did in a past life to end up in that job, and what the heck I did to end up like this!0 -
Sure they can break in, just the same as a burgler can break in. They would be breaking the law just like a burgler. Its a bit like when DCA's send letters saying we may take you to court. Its civil court, NOT criminal court, totally different.
There was a TV show on bailiffs and most of the time it was them waiting around for someone to be in. Even when they found the person in there was more waiting around, as the links suggest a bailiff does not want to remove the goods. They want cold hard cash, and if they can't get it, and there's nothing of value (ie stuff that would raise money to cover the debt and thier fees at auction) then there's not a lot they can do other than send it back to the council saying we cannot collect on this.Mixed Martial Arts is the greatest sport known to mankind and anyone who says it is 'a bar room brawl' has never trained in it and has no idea what they are talking about.0 -
Well I cleared out a travel bag with personal items and I was shocked to discover that all that mattered to me in the whole world were 2 work related computers - left all my clothes and stuff, furniture etc for them to take if they broke in. My neighbour said he'd call me if he heard any kind of rumpus - so far no call, but I full expect to come home to an empty flat tonight. Doors were all locked and I have sent off letters to them and pinned a copy for them to pick up when they visit. Working late so heaven knows what I will find when I get home, probably a wp order through the letter box. Trying to raise an extra £200 so I can do the deed on Friday, but no paperwork completed so bricking it all now. Not concentrating at work as I couldn't sleep properly - didn't think it would affect me like this.0
