After reading your post, it occured to me that as was mentioned in another post you should have a form every year from CA asking if your circumstaces have changed. If you haven't had this form that may go in your favour a little bit.
If your wifes boss filled the form in not her, i can't see how there is anything further to investigate.0 -
why do people have to bring immigrants in to it? immigrants are not a defence for anything . This cple need to email their MP and get and see a lawyer ASAP0

I dont recall having a form from them every year, as i said we had 1 around 2 years ago and completed it and sent it back, but heard nothing0 -

Sorry but I am with Sh1305 on this one. Anything to do with any benefit regardless of what the benefit is or what it is for tells you to tell them of any changes however big or small that may effect your claim. I really don't see how anyone can be overpaid by accident when they fail to tell the correct people of changes. I have been on benefits due to disabilties for a long while now and everything that changes down to my mums working hours (as I live with mum) I tell them of and I think I would rather tell them every tiny minute detail even if it means nothing to them than to end up with a situation like the OP's because I didnt think it would matter.
While I agree with your point about its plain & simple that you have to inform them of changes I don't understand the whole carers allowances anyway.
I don't think non-means tested carers allowances should be paid for caring for spouses or children after all we as adults make a commitment to both of them.
But with other relatives its different.
If the person needs care & the OP & wife are providing it 7 days a week (meaning its really needed 7 days a week) then I don't think it should be means tested.0 -

No one can tell you definitively what will happen,or why they are now making further enquiries.
I assume that when interviewed under caution the DWP stated that you had been advised that any change in circs was to be reported? and they had sent out the normal change of circs form at the review date? it does seem strange that you state you have not had even one of these over eight years, they will have a record of when they were sent out. It seems likely they do not believe this was a mistake and in the current climate are enforcing a zero tolerance approach to what they deem fraud, to send a message out to all that it is unacceptable. Community service may be the likeliest option, as to whether she will lose her job? it depends what it is and whether she is still viewed as trustworthy by her employers, whether for example she needs a clean CRB/
No one can give any advice really as the permuations of what could happen are endless. Sorry if this wasnt what you were looking for, but on a forum you will get comments you dont necessarily want to read, such is the nature of the beast.0 -
Has your wife used approved paid childcare at any time in the past few years? I believe some childcare costs can be discounted from salaries for CA.The IVF worked;DS born 2006.0

I don't understand your working out - you say your wife has only had an increase of 31p per hour over a five year period
yet in your first post, you claim that she was £28 per week over the earnings threshold for £100 per week which is where the overpayment has arisen
if she only had a 31p per hour increase - that would mean she had to work 90 hours to reach £28 over the threshold.
I find it hard to see how she managed to work 90 hours in two days0
