Maybe so but I would guess that many people get caught out when they get gradually increases in earnings like this and even you must see that there are genuine cases where people make honest but regrettable mistakes? I've certainly made mistakes in life-fortunately for me they have never been in filling out government forms, as far as I know (fingers crossed!) As a carer myself I know how hard it is and generally thankless.
I'm a carer for my MIL so I know only too well how hard a job it is, but I also know I can't earn over £100 per week whilst claiming it, just seems lately that everyone on here looking for advice on benefit fraud did it by mistake and didn't realise what they were doing.
The OP's wife was aware from the start what the threshold was and chose not to keep them informed of her increase in wages.
She has been way overpaid over a very long time and it needs to be paid back.
She should probably seek legal advice because from the sounds of it they may make an example of her.0 -
I have received a court summons for non-payment of council tax.
Basically, now if I dont pay in full or cant pay in full, Will a liability order still be taken out ?
If after you have been issued with a liability order, how far away is the prospect of going to prison.

i can't understand how she didn't realise, to be honest, the information is not exactly hidden about the earning limits.
Have you also informed tax credits of the carers allowance?0 -

when you have a mother thats been in hospital pretty much every year with heart failure it kinda takes the importance of the "small print"
All were trying to do is raise 3 kids work as hard as we can and look after a sick mother, if she had previous this id say through the book at her, but she is the most introvert person i know.
Please dont judge her by her misunderstanding, i find that a little like a witch hunt, i came on here for advise, not to open the flood gates on my wife thats already suffering stress through this!
Please all i look for is advise not abuse or finger pointing.

my posts were not meant to be abusive or finger pointing - but as many other contributors to this thread have already stated, there seems to be a selection of people who always seem to be overpaid thousands of pounds of taxpayers money " through no fault of their own"
the onus is ALWAYS on the recipient of any DWP benefit to ensure that they still meet the criteria for claiming - DWP departments are in enough of a mess at the best of times, to expect the staff to constantly write and double and treble check every claim for every benefit every month is ridiculous.
I appreciate that caring for a relative with health needs is difficult - my husband and I have two sons, one of whom is severely disabled with Aspergers Syndrome and semantic pragmatic language disorder and the other has a physical disability which has required 3 major surgeries over the years and constant daily physiotherapy
caring for an ill relative is sadly no defence against benefit fraud.
the current state of our economy is such that we should be applauding the DWP for recouping overpaid benefits - not having a go at them.
I appreciate that very few of us would be able to find £11,000 to repay overpaid benefit within a short timescale - however the point is, that it must be repaid.
My ds2 was awarded a sum of money in compensation for negligence during his birth which resulted in his physical disability and from the compensation we had to repay over £6,000 in Disability Living Allowance which he had previously received - I was happy with making the repayment, as the DLA was a godsend to us when we were travelling to a hospital over 100 miles away for appointments every month - and once we had received a sum of compensation which recompensed us for those costs, it was only fair that the DWP should be reimbursed.
benefits are there as a lifeline and if the country is to keep funding those in genuine need, then those who aren't eligible must be made to repay any overpayments.0 -

Thank you skcollobcat......however, if I were to come on and shout out that all people on carers allowance were skiving and taking all the handouts....and more than they were entitled to....I'm sure the OP would see it the same way. Just get tired of all the immigrant comments and free handouts. And yes, it's not just immigrants, the ONLY skivers I know of are of the homegrown variety - however I live by several Polish immigrants - who have to be the hardest working people in our neighbourhood! I guess it comes down to not generalising where you don't want any generalisation applied to you!0 -

Reading your comments i feel you to have had a hard time of this, i have said before i understand the amount has to be repaid and i have no issue with this at all, i agree it was an overpayment and yes i will pay back every penny i owe, its the way we are as a family, i will not EVER borrow anything i cannot afford, im just concerned for the well being of my family.0
