i can't understand how she didn't realise, to be honest, the information is not exactly hidden about the earning limits.

Have you also informed tax credits of the carers allowance?

It also says on any letters you get from DWP, that you have to inform them of any changes in circumstances.

sh1305 This family are hardworking very busy people. The wife looks after a relative, works and has children to look after.

If you were that busy in your life, you would also miss the small print.

Being hard working has nothing to do with it. It's not exactly small print.

  • No I haven't had a hard time of this as I do not claim carers allowance for anybody. I pay my carers in a private arrangement. They work and the reason they will not claim carers allowance for me is that they get over the £100 limit as they work elsewhere also. I think it is wrong to treat carers like this and I do hope your wife gets everything sorted, it must be so hard for her and bringing up the children as well.

no not easy at all, i work long hours and and the 2 days i do get off my wife works and i look after mum and the kids, we just seem to pass on the stairs :( but hey that how it is here right now i guess, were lucky to have our family and jobs so for ever gratefull for that small mercy

I have to say I totally agree. Yer, she made a mistake but the figures of her over-earnings are relatively small-I think it is a disgrace. I would say go to see your MP-maybe they could make a test case out of this, but my own experience is that they say the rules are the rules.

A test case can only given an interpretation on the current law, so would not be relevant here.

I agree - whilst some DWP letters are not the easiest to understand, those relating to DLA and CA are very clear, and there is no small print.

OP, can you clarify what information/ advice you are looking for?

For information such as this you need to consult a solicitor. We could give you the possible outcomes, but doing so without the full facts of the situation is likely to cause you more worry than good.

The Community Legal Service would be a good (and free) place to start.

People are not being insensitive, just giving differing viewpoints. In situations like this not everyone is going to agree with you - it does not make them wrong.

Sorry but I am with Sh1305 on this one. Anything to do with any benefit regardless of what the benefit is or what it is for tells you to tell them of any changes however big or small that may effect your claim. I really don't see how anyone can be overpaid by accident when they fail to tell the correct people of changes. I have been on benefits due to disabilties for a long while now and everything that changes down to my mums working hours (as I live with mum) I tell them of and I think I would rather tell them every tiny minute detail even if it means nothing to them than to end up with a situation like the OP's because I didnt think it would matter.
