  • Is that what MSE is all about then......rallying people together to 'tell' on people who do something you dont like on another website?

    If you have a problem with that seller, then inform Ebay......but you have a bare faced cheek to come here and rally together mobs of people to do your dirty work for you..............especially when Ebay's own community boards DO NOT permit posts that ask for "snitchers".
  • I've already reported them, so if you could just sod off :)

    Also, if enough people report them then maybe one day eBay will take notice as they have been sellin lots of high value item,s for some time.

    but......this is not the place to do it. Ebay do not allow you to make these kinds of posts on their boards, so why come here to do it?

    You are effectively asking people to blindly report someone for doing 'wrong' on your say so only......sheeplike behaviour.

    Would it be fair if I were to list your Ebay page (if I knew it) and asked on here for people to report you on my say so only?

    If they are an unregistered high volume business seller, find out their location, and take it to their local Trading Standards rather than eBay.

    eBay don't have a mechanism in place for reporting these people, their dragnet may pick them up, but TS will be very interested as what the seller is doing is against the law, so it's the same as reporting any other legal issue to them.

    It's only really eBay that allows this to go on, partly because it permits private sellers to sell in most if not all categories; other sites are much, much stricter, so reporting not only makes sure they are paying their taxes but also fulfilling their responsibilities to their consumers but that eBay sellers are compliant with the laws that apply to eBay sales as they do to any other sale in the country.

    #6 - they're breaking the law, simple as that.

    Im thick, and want to know more...apart from obviously not being registered as a business seller, what are they doing wrong? Why would trading standards be interested? Whats illegal? (unless of course the cars are stollen!!!!)

    Because the seller is not declaring themselves as a business as per legislation introduced in 2008. Businesses should declare themselves as such, which eBay take to mean they should have a business account, which displays it automatically on their listing (alongside contact details, which are also required); consumers have more rights when buying from a business so it is not legal to misrepresent yourself as a consumer to get out of providing those rights (which include items that come under the distance selling regulations).

    TS is the body that polices this and can actually enforce it, unlike eBay, which has to make it possible for people to comply but doesn't really provide the facilities to report them.

    BTW, "illegal" doesn't necessarily mean just "the police could arrest them". It also covers issues of consumer and employee rights, and if these are broken fines can be imposed and civil cases (e.g. through the small claims court) can be brought to enforce a customer's rights. Tax evasion - where the business is not declaring its income to HMRC - is a crime, and unless this person has declared everything to the tax-people, they could have a criminal prosecution brought.

    It is likely that someone operating may be registered for tax, but not want to register with eBay as a business because they would have to offer additional consumer rights. Since there are no terms and conditions regarding returns, they are obviously not happy to register as a business because they would have to establish these conditions. I know of a lot of sellers on the old eBay business boards who apparently don't want to tell the consumer of their rights because they don't want to be scammed - which is definitely illegal :( because that's part of what the law requires when trading online.

    Yes, but people would only have my word for it that you are breaking the rules.

    Same as the guy you want people to report for you. Most people will just 'take you word for it' that he IS doing something wrong.
