Car ownership proof dilemma

Can someone please advise me on what to do here. I have a car in a garage its been there since it was involved in an accident this year (not my fault) the insurance company wrote it off. The guy at the garage said he wanted to buy it but still has not paid me for the car. He states he was paying me with the recovery and storage costs payed out by the insurance company hes spent it and still not paid me. I have spoken to a lawyer who says theres little i can do even though the car is still in my name on log book and on receipt from when i bought the car. He is refusing to allow me to take back my car as he still says he is going to pay for it, the police say its a civil matter and refuse to get involved i just want my car back so i can sell it myself to someone who is going to pay me for it. can someone please help ?

If the cars a write off and you have been paid by the insurance, its not your car.
