    Hi everyone,

    Another question:

    What paper work will they need to see?

    Also how far back do things such as bank satements need to go back?

    What about CC statements - I don't keep those.

  • HI Goldy,

    The court will send you forms you need to fill in for Br. You list in this all your creditors and how much you owe them, you also list your outgoings and present income.

    My experience is that this is all you need for the actual br. It's the OR who will want to see bank statements, CC statements, wage slips etc.
    I think that it is down to situation as to how many months worth of each statement you have to send.

    I was asked for 12 months bank & credit card statements. This was easy in some cases, but others were more tricky (online statements!) I called the OR office to explain this - they said that 12 months was a limit, and not always necessary to produce - it just stops people sending years worth of statements.

    This is all in the case of my petitioning for my own br - I think its different if your business is involved. I'm sure someone on here will know the info!

  • Do It Online!! It is so much easier!! Also, if you find you need to change something, it is easier to do that too. When you have finished on https://www.insolvency.gov.uk, you click on submit, usually the day before your Court Date, and it then gives you a printable version which you print out and must take to the Court with you aswell. Also, the Court Officials prefer them to be done on line since they are so much easier to read!

    I don't have any of my cc statements at all, but I have all my bank statements. Don't worry about it! The OR will get them from the Company concerned. As far as I can gather, the only items on a cc that they are interested in are items over £200 in one transaction. Same with bank accounts too, apparently.


    Now I am finished work I have too much time on my hands to think about the paiin from my arthritis, that is the problem! Thanks for the hugs, much appreciated!

    Great news!! Glad you have your date. I guess that someone applying around 1st December is going to have to wait well into January. At least this way, with your date on 29th and mine on the 20th, we are all sorted by Christmas and we can start the New Year afresh!

    Your disposable income has to be above £100 per month before you would get an IPA applied. The "disposable income" takes into account everything you need to pay for, plus allowances for incidentals and clothing. On disposable income of £100 the IPA would be £50 per month. I posted an IPA chart further back on this thread.

    A quick question - if any disposable income is made up of mostly benefits (housing, council tax, DLA, child & working tax) would that be included in the IPA?

    They specifically will not include any income that comes from State Benefits. They will work out your incomings from paid work only, the state benefits are disregarded as part of the calculation.

    Thank you, it really does help. Just working out what to do at the moment, hopefully by the end of today we will have decided and started to take action.

    This thread has been v helpful and is wonderfully non- judgementel, thank you to all those willing to take the time to help and reassure others, even though some of you are going through tough times yourselves.
  • There has been some fab advice on here over the last few days. It just shows you how much support is out there for people who need it. My Bday went quite well yeaterday.. Just long winded really !

    Im glad its all over, I slept like a baby last night, forst time in ages.. Dont owe no one nothting... not even a £1.
