Hi sarah,
We're over five months into BKY and the number of telephone calls and letters prior to and in the weeks after our BKY was mind numbing. My O.H would just ignore the phone, refuse to even look at the post it was the sort of thing nightmares are made of.
It's too late for anybody to commence legal action against you so just sit back and wait for the 29th.
It's quite funny now to watch my O.H answer the phone to the more persistent callers and calmly quote the BKY ref number, refuse to give any personal details, inform them that the call is recorded and if they persist in calling again she'll inform the relevant authorities.
Wishing you all the best,
Richard0 -

Hi,
Thanks for all your previous advice. First an update:
BR day is 16/01/06 09.30...I am officially panicking!
Now the question(s):
1.Due to health reasons, I was redeployed after maternity leave & returned to work on 30 hours/week. I have struggled physically & emotionally with this working week. This week, I have permanently reduced my hours to 1 day per week. Will the OR see this as contributing to my situation, and therefore worthy of some restriction? I was only working a 4 day week to try and (unsuccessfully) service our debts.
2.Our budget will (as for everyone) be quite tight. I have been on entitledto.co.uk, and this suggests that we will be entitled to an amount of housing benefit (£25 per week), which will be fairly crucial to make ends meet.
If we are both put on a zero tax code until April, our income will effectively go up. I know the OR will want an Income Tax IPA, but will the 'apparent' income increase stop us getting housing benefit?
My concern is that we will seem to be getting more income than we are, and so will be denied the benefit, even though in real terms we satisfy the criteria.
3.Our SOA is quite lean, but I had followed advice from posters regarding allowances for christmas/birthdays/holidays. Now I see that there is mixed opinion as to whether these are allowable in practice, although technically allowed in the manual. As some of our forecast expenditure is lower than the amounts allowed for a family of three, is it better to adjust it to ignore christmas/birthdays/holidays, and increase some of the lean areas? I have spent so long without the means to live 'normally' that I don't know what a 'reasonable' expenditure is anymore!
4.I have asked this before, but got a bit confused. My husband and I both own cars with value approx £500. My husband works full time, and I work 1 day per week, during the time that he works. He works in Eastleigh, I in Gosport (several miles from each other). There is no easy public transport route to my work, or his.
The forms ask 'do you have access to another vehicle?' I technically can drive Ben's car (I'm fully comp, & 'spouse' is on his policy), but obviously he has the car at work each week day. He is named on my policy as a second driver, but I need the car for work & to transport our daughter around.
Do we say that we have access to each other's cars, or not? Also, is it likely that the OR will want to take one of the cars? If he does, do we get to choose? Ben's car is a J reg Peugeot 205 automatic, fuel hungry, and not too safe for Millie. My car is a N reg Ford Mondeo, diesel, & safer.
You can see I am panicking!! Thanks in advance

I also need to ask about my credit card.
My hubby and I stopped using all of our cards when we made our big decision, except I withdrew the £1000 fee for our bankruptcy. However, just before this, I paid £129 for a year's car insurance for my mum & dad (they don't have an income right now- long story - & need the car to come & look after Millie when I work). I have just got the statement through, and the insurance payment came out after the £1000, so it looks like I used the card after I drew out the £1000. Also, a payment slipped through of £5.95 to gamepass, which I thought was cancelled.
Am I likely to get a BRO? I didn't intend to be naughty, but it looks like i did :embarasse

goonergirl wrote:Oh do you think that I will be able to do that?
Do you think I might be able to do this when the OR calls?
That would be better then I can make them see how this is as much my fault as his and that if I had been a bit stronger in saying no to him we might not be in this situation and He might not get so stressed at me cos he don't know what to say.
I think I will ask though not sure if Im able to ring back yet as i bit tearful today.

As long as you have not tried to mislead or claim false expenditure you will be ok. The judge will generally understand as he sees loads of cases. My number was 15xx of this year!! So he will probably have come across similar cases to yours before.
The judge we had was a real gent and totally non-judgemental over the circumstances.( business failure to the tune of around 140k) He wished us the best of luck to start again which is what it is - a new start.
Just as a matter of interest I would be careful on your housekeeping figures as our family of 5 only budget £550 monthly as advised by the OR. We actually eat well by shopping at Aldi and Lidl where the food is just as good if not better than the major chains but about 35% cheaper. Generally spending £45 - £50 per week on food items ( including a few treats for the kids).
Be careful where you get figures from . Just be honest and everythinhg will be ok.1/11/06 -1/06/07 BSC #42

Hi
With your figures being so tight You may have to take out holidays and Christmas and reallocate the sums . Your phone (combined) and internet may be queried too or you may be asked to justify internet and top up.
Suggest you hang on on here and someone will be able to give further advice.

First of all DON`T PANIC please.
It seems that you have a couple of areas that need expert advice. I suggest that you try and get this through CAB money advice unit or similar debt management agency. Make sure you speak to the specialised money advice unit as not all CAB volunteers are au fait with this area. Try and get through by phone as you could then email the soa and content of your posting.
Best of luck
