    you mean take £475 to court, how long does it take to get to court and how would i know which court it would be? are you goin through the process at the moment?

    You usually have to make an appointment with the Court.

    Your Court has to be the County Court which is local to you, one which deals with bankruptcy

    Yes, the funds must be taken to Court on the appointed day. The £150 can be waived if you are on certain benefits, there is a court application form to complete for this.

  • Sometimes you will wait one week for an appointment - my local court is currently six weeks. Brighton Court is running 4 months' behind!
  • You take your paperwork to court and are declared bankrupt by the Judge. You then have an appointment with the OR.

    The bankruptcy lasts for 12 months maximum. Early discharge is possible as early as 5 months.

    Liverpool court is 1 week....

    I have been advised by my OR that they will apply for ED after the MINIMUM 3 months, so sandra is very right in saying it takes around 5 months

    hi with the other money for the court(the amount that you dont have to pay if you are on benifits)where do we get the form from and do we fill it in before or when we get to the court?

    Do I have to pay court fees ?
    You may not have to pay a court fee if:

    a) You are on Income Support, or

    b) Working Tax Credit, where child tax credit is being paid or there is a disability or severe disability element and the gross annual income taken into account for the calculation of working tax credit is £15,450 or less, or

    c) Income based Jobseekers Allowance, or

    d) Guarantee credit under the State Pension Credit Act 2002, or

    e) Payment of a fee would cause hardship to you.

    f) You are in receipt of "Legal Help" from a solicitor, or

    g) You are in receipt of a "funding certificate" from the Legal Services Commission. You must complete court form "Ex160", (application for a fee exemption or remission) for each court fee you cannot pay for one of the above reasons.
