    Last question (for now lol) once made bankrupt, what would happen say if a letter dropped on the door mat for a past debt, is this possible or could debts be missed by the court, or do they find absolutley everything no matter what, even if it hasnt been defaulted?

    First of all going bankrupt as a couple means you pay TWO fees, since you have to go bankrupt as two individuals, so 2 x £475. That applies whether you are married or cohab.

    You don't need your CRF from anyone - but you do have to be able to complete your SoA for the OR. Have a look at the form at https://www.insolvency.gov.uk

    When you are made bankrupt everything is included, whether you remember about it or not! No problem there!

    Where the cars are concerned, it is entirely at the OR's discretion whether you can keep them or not. It is considered a secured loan, unless it is on HP. If a car is on HP then it will be repossessed.
  • oooh can i join- i went br 9/2/06 and was discharged beginning oct 06! im debt free and have finally learned to live within my means (ok its an on-going lesson) and this site is so great with helping to achive that! batch cooking, budgeting etc... have sworn off credit and am learning to wait while i save. may never be able to get a mortagage so im told but im living in the now and at the time br was my only option as recomended by cccs.

    Hope you found the process not too dauinting.. Im nearly a month in.. Things dont seem to have changed that much really.. Just dont owe anyone !

    Thanks for the replies, the SOA form looks a nightmare to fill in, the idea of getting my credit files was to clarify exactly who i owe money too and how much, i can imagine there will be lot! in my case....

    My car is on hp, but only got finance for 1500 quid at the time, that was 6 months ago, i dont really wanna lose my pride and joy if i can help it....

    I'm getting bailif letters at least twice a week now for past debts, scary they are too, one a while back was even threatening imprisionment!

    I feel i need to act fast to get the ball rolling, but wanna be 100% sure i take the correct path before i do anything....

    Hi Georgina,

    I understand that there is quite a growing market in mortgages for discharged bankrupts, the rate is higher than the average high street rate but once you've established yr credibility for a year or two then you could well be accepted by one of the mainstream lender.

    Don't know that for a fact cos we're not in a position to apply at the moment, but it makes sense from a lenders perspective. They know you've got little or no debt and more than anybody you're aware of the dangers of over stretching yr finances, add to that a couple of extra percentage poitns on the loan and it's a proposition you could sell to the "Lion's Den".

    Thanks sent off all my cut up cards and all the cards that I owned along with a note explaining the fact that I destroyed most of my statements. Time to enjoy my 1st weekend as a br:beer:

    We were declared bankrupt in July this year nos 220&221 / 2006. Just had a peek at the local newspaper and before the end of Nov 06 they were up to case 992 / 2006.

    It's only a small town too; does anybody think the BKY Badge could become a must have fashion accesssory??

    Always wanted to be a trend setter :j

    I wasn't asked for credit card statements - just the balance. :confused:
