    I still think the OP is perfectly entitled to a refund, unless the store can categorically PROVE the image is a copyright breach (which it isnt).

    Does seem slightly odd though. I've not heard of them doing that.

    Can't comment on a refund- does sound strange they wouldn't give one though.
  • How on earth does she know it wasnt even taken by a friend or a partner.. I have loads of photos with just me oin them and have never been questioned about them. Refund.

  • should have told her it was your identical twin sister in the photos - then when she asked you to produce her, you could have said "sorry shes gone back home to Australia/USA/South Africa/Mars
    or wherever - I'm sure that would have given her more to think about

    What if you ask someone to take your family photo whilst you're on holiday then? Does that mean you can't have your photos either?

    All cameras have timers, so her 'objection' is nonsense. She's just a nasty little jobsworth trying to be important. Make a stinging complaint to ASDA head office (letters to stores are binned).

    There are several possibilties. Theft of original film negative/memory card. Breach of contract.

    You might also point out her arrogance is now getting ASDA a great deal of free - and bad - publicity on MSE!

    why would it even be a copyright issue if its a quality photo, with you in it? even if you paid a studio for the shots, you own the copyright, the photos, and the original film or digital files?

    They can refuse to do the print for you for not proving you took the shot (even though the above post is correct - you own the rights to it), but there is NO WAY they can refuse to refund you without proving you did NOT take the shot.

    I would take this higher up the chain and DEMAND your money back. Imagine if Asda pulled this stunt on every customer with a digital camera, they could make a handsome fortune out of it.

    Some people have made comments taht are slightly incorrect though. I am supportive of photographers and their work. If a professional photographer takes a photograph of you then they actually own the copyright unless they physically (IE in writing) sign it over to you.

    If I had known that they were going to ask for proof some time after taking payment (remember they take phone numbers in case there is a problem with your order) then I might have thought of taking camera setup, I will merely leave a little more time in future and use an online processing service in future.

    I would not have been so annoyed, but it was the fact that they basically told me I was lying that I had taken it, even though I provided a perfectly reasonable excuse and even then they refusing to refund the money. Credit where it is due though, they have now refunded the money after I went back in and saw a different manager. Their attitude was that my explanation of how the photo was taken is plasuable "although unusual for their usual clientelle". [for the record I do print some at home, however I prefer to print ones I want to keep or give as presents elsewhere as I find my printer is not always the best quality].

    They did offer to print the photograph for me at the usual rate... LOL as if I would!
