    I cant believe someone would send a phone as new as an X10 without paying a few quid for Special Delivery

  • Well, I'd have sent is special delivery, as I do all important correspondence. But that's irrelevant to issue.

    I guess there is probably a distinction between
    • Paying the costs for customers to return something to you.
    • Providing a return service for customers to use.
    If that's right, the issue would be which of these happened in this case.

    If Sony Ericson send out prepaid envelopes, I can see how one would reasonably think it was the latter (whether one would be correct in thinking that is of course a further matter).

    But I'm curious as to what people with legal knowledge say about such things.

    For example, I'm currently sitting on a virgin media cable modem and set top box. They've provided me an envelope to send it back to them with. Will I be liable for the costs of the items if it goes missing in the post? I'm certainly not willing to pay for recorded delivery. So I guess I'll have to call them....

    If a package arrives then generally you open it, that's what they will have done, ahving no idea what is meant to be in it or who it is from until they open it. At which point they find documentation for the phone but no phone.
