PayPal Claim & BEWARE THIS SELLER

Hi,

I'm making a new thread for this topic: http://forums.moneysavingexpert.com/showthread.html?t=269486

Basically now I've got to go and get proof from a computer shop or something that the remote is not as described in the listing.

And you'll see that she's had a few negatives recently - I'm so tempted to add my negative but the problem is that she hasn't left my feedback so I'll end up with a neg as revenge. Do Ebay delete unfair feedback at all?

This is one of her latest negative feedbacks for a buyer: CANCEL ALL BIDS, CONTACT ME FOR DETAILS, AVOID THIS EBAYER HE IS THE WORST!!

Charming or what? :rotfl: I have a feeling I have the same in store when PayPal sort out my dispute (after I've been to get the "proof" even though in the correspondence she's admitted to sending me a different remote).

  • I think feedback once left is there to haunt forever unless you mutually withdraw it, but even then just the stats are updated the comment remains albeit minus the big fat red sign :) But I may be wrong as i've never had need to get feedback removed... yet :o

    'Resolving Feedback Disputes
    To maintain the integrity of the feedback system, feedback left for a member generally becomes a permanent part of that member's record. The comments cannot be edited at a later date. We encourage members to communicate with their trading partners prior to leaving feedback since most misunderstandings can be resolved quickly through direct communication. eBay's Feedback Forum is a place for members to express their opinions about a specific transaction. eBay will not censor these opinions or investigate the comments for accuracy.

    There may be times when you may be unhappy with feedback you have received or regret feedback that you have left for another member. If you find yourself in a disagreement with one of your trading partners over feedback already left, you have a few options to resolve the situation:

    1. Reply to feedback received:
    Share your side of the story by responding to any comment that has been left for you. Your response will be shown directly below the comment left by the other eBay member. Reply to feedback you have received.

    2. Follow up to feedback you have left:
    You can leave one follow-up comment to a comment that you have already left, to add information or clarify your earlier comment. This will appear below your original comment. Follow up to feedback you have left.

    3. Mutual Feedback Withdrawal:
    If both you and your trading partner are able to resolve a problem after feedback has been left, you can mutually agree to withdraw the feedback rating. The feedback comment will still appear in your member profile, but it will no longer count in your feedback score. Both members must agree, and feedback left by both parties will be withdrawn at the same time. Start mutual feedback withdrawal for a transaction now.

    4. Dispute resolution through SquareTrade:
    SquareTrade, a dispute resolution provider, offers a free Web-based forum where you can work out problems as well as access a panel of professional mediators who can help you resolve your dispute. Start the process to resolve a dispute via SquareTrade.

    5. Feedback removal:
    eBay will remove individual feedback comments only in very exceptional circumstances, when they violate specific policies. Some situations where eBay will remove feedback include: Feedback left by a user who is indefinitely suspended within 90 days of registration, feedback containing vulgar language or personal contact information, and instances when eBay receives a valid court order to remove feedback. See a list of situations where eBay will consider removing feedback, and how you can file for removal.

    6. Rating withdrawal:
    Feedback ratings are withdrawn when a member fails to respond to an Unpaid Item notification and the member filing the claim issues an Unpaid Item strike. Although the feedback rating is withdrawn, the comment will remain, along with an eBay administrative note explaining that the member did not participate in the resolution process.

    I phoned PayPal yesterday and they were very nice about it. The seller, meanwhile, has had more negative feedback but always replies with total sh1te to make it look like she's right. Oh and she responds to the buyer with a neg then gets mutual withdrawl which really highlights a big flaw with ebay.

    I don't think I'll be using ebay after this little debacle :( Thanks for the replies,

  • She's playing her buyers' fears about having a neg. Really, a retaliatory neg stands out a mile off. Why should she get away with getting mutual withdrawals just because people are worried about a red dot on a screen?

    Oh, and if you're not going to use ebay any more, you have nothing to fear from a neg!

    LOL but I've had a change of heart - just logged onto PayPal and it says "A claim has been issued against this transaction" basically saying further down that the seller has till 8th October to refund me or disagree with claim :T So maybe I will use ebay again after all :rotfl: :p

    So relieved they didn't fall prey to her sly antics! Go PayPal! :D :T :D :T :D :T

    You can always post a follow up to any neg feedback left for you. You can use this to say it is a retaliatory NEG and buyers should check out her feedback and the feedback she leaves for other buyers.
  • OK I've had an email from Paypal:

    The seller has offered to provide a full refund once you return the item in its original condition. Please send the item to the seller at the following address:

    South Yorkshire

    You are responsible for postage and packing costs associated with returning the item. Once you send the item, please provide us with an online tracking number by 13 Oct. 2006. This tracking number allows us to confirm that you sent the item. Please understand that if you fail to provide this information, your case will automatically be closed.

    We recommend that you send the item using a service that can supply proof of postage or a tracking number. Otherwise, you may need to rely on the seller to confirm if the item was received.


    So I need to send it back to the seller in its original condition - bear in mind that the item is not as described (and faulty remote!) so why am I supposed to pay for the return (recorded delivery) postage? I thought this was the law as it isn't my fault but PayPal don't seem to have allowed for this :confused:

    Also, I'm concerned because when I bought this item the address was somewhere in Nottingham, now it says South Yorkshire with a different postcode :confused: is there a rational explanation for this? :o

  • An update - the item was recived by the seller (according to Royal Mail website).

    PayPal asked me to fax a barcoded cover sheet with the royal mail receipt showing address & tracking code etc. so as soon as they see it on Monday, I should receive the refund. Apparently I should have got the email when the barcoded fax entered the system but maybe it will come on Monday :o

    Oh and this is the latest feedback from her for one of her victims: SELLERS BEWARE - she will NOT read listing but will leave neg w/o any contact!!
