The best thing is to renew your licence when it nears it's valid till date, as that is what you are supposed to do, not try and be a smart !!!! and think of ways to get you out of trouble. Nothing wrong with dealing with a situation before it happens.

I hope you post the results when you don't renew your photcard licence as that seems to be what you advocate the OP does, I however advise him not to drive until he gets it renewed.

I already renewed mine in advance of it's expiry as required by law to avoid the £1000 fine for non renewal.

However the OP had already passed this expiry date without renewing, realised his mistake and came here for advice on what to do now.

The simple fact is that the £1000 on failure to renew will happen regardless of whether you drive or not (same as failing to declare SORN) and your entitlement to drive is not affected. The OP therefore needed to get that renewal in ASAP and hope it is processed before the fine is processed. The OP has already broken this law and the only advice you or I can give is how best to mitigate the effects of doing so.

Their entitlement to drive still stands. The OP breaks no further laws by continuing to do so.

And yes police can and do make mistakes all the time. In one of my cars I keep a copy of the numberplate regulations that was given to me by a senior compliance officer at VOSA* as I have occasionally been pulled for having "illegal" plates that are in fact perfectly legal on my car.

*said officer also thought my plates were illegal and gave me that regulation. I pointed out the very clause that makes them legal and he grudgingly accepted then went off into his office to sulk.
