Safeguard yourself by taking photos and getting an independent witness to certify the photos and that the car is in the same state it was when they delivered it. And tell them it is unacceptable they cannot collect it till next week, you cannot take responsibility for any damage that is done between now and collection, cannot store the car for them and it is left parked on the road.

my brothers car was shunted, it was parked and empty. he claimed through his insurer on the other cars insurence, he got a 10 reg 4x4 as courtesy car, (5k rent/month) which went straight onto the other drivers costs. all costs/repairs are recovered from the other party and if your insurer is reputable, they will take all the hassle from you and let you relax. your claims wont be effected.

Your brother actually signed a credit agreement agreeing to pay the hire company back with a year it makes your brother liable for the costs. There are some situations where he would not be liable for the costs eg if they offer an insurance against him having to pay otherwise your brother is liable for the costs if the other Insurer does not pay and it is not unusual for them to refuse to pay

Thats really important. If something happens to the car, you are liable for the damage. And they will try and scam some money out of you. Phone again and demand they take it from you. Its funny how they can provide you with a car within hours of the accident...yet can't possibly collect it until Monday. Please, please keep phoning them.

As above. Credit Hire Agreements are how this particular company operates. The insurance mentioned above does not cover him if they decide the accident is your fault - regardless of how they try to sell it to you. I speak from personal experience on this one. It is also not unusual for the insurer to refuse to pay. It is at that point your brother would regret signing a credit agreement for a £5k a month car :)
  • Hi OP. I have sent you a PM.

Beware getting pm's from anyone breaking MSE rules and touting for business!
  • Noted. Having spoken to Drive Assist again this morning they have now agreed to pick the vehicle up today between 12 and 5. My wife have done about 5 miles in the car on day one prior to me coming on here. Can I record the driver who is picking the vehicle up confirming the car is ok or get him to sign something myself? Unless I get an independant witness to sign photo's at the time of collection it would be a waste of time as they could claim something happened between time of photo's and collection?

Again, thanks for all your advice and help. It's been invaluable.

Yes, be sure to get a receipt for the car saying it is in the same physical condition they delivered it in.

(Have one prepared in case he says he cannot give you one himself)

(Report any pms you get touting for business to abuse!)
  • Hi, sorry, i wasnt touting for the wrong reasons. Just giving advice as i work in personal injury and maybe could have helped with the OPs PI claim, and helping him to push for his vehicle hire as his insurers were being difficult.

    cheers.
