    I wouldnt get your hopes up too much, volenti non fit injuria is a fairly common defence for this type of claim.

    would the fact that club's ground's having inadequate fencing affect a defence of "volenti non fit injuria"? The ball leaves the grounds frequently due to a low fence which has been reported to the club and the environmental department in the past.
  • They explained that it would not affect my no claims unless i did make a claim through my insurance, but the incident needed to be logged.

    They always say that of course, until renewal time comes around when you find you have been penalised for no fault of your own other than you are now a person who is more 'likely' to make a claim

    Insurers, always like to have their cake and eat it

    No I had the club to come and collect the ball after I had taken a photo which conveniently had the name of the club on. Apparently you can get done for theft if you decide to keep the ball and not give it back to them.
    This is a crazy world especially now that I may even now not be able to make a claim.
