OK, so have i got this right... incapacity benefit ..

    when you call jobcentreplus to make any claim the questions you answer determine the benefit you may be entitled to, you don't just phone up and say I wan't to claim IB, there is a process to go through...

    No you phone up the ESA line, or the Income support line, or the IB line etc and start your claim.

    Or you pick up the claim forms.

    You may be guided to the correct benefit, but at the end of the day, it is the claimaint who CHOOSES and AGREES to claim that benefit, no one is ever put on a benefit unless they themselves agree to claim it. (unless someone else is in charge for that person, say they are in a coma for example)

    Crisis loans... which have to be paid back.

    they are supposed to pay housing benefit etc, but at this rate, we risk being evicted before they get it sorted.

    Im waiting for a new ESA claim to get some benefits re-instated, but I was told originally I did not need to claim ESA as Income support would pay.

    Even welfare rights/DWP cant agree on things...

    obviously, the point I was making is when you call and give your circumstances you're told which benefits you MAY be entitled to, you don't always automatically choose which benefit to claim.
    I know you have a huge chip on your shoulders regarding ATOS so I'm just going to leave it at that...

    "from the information you've given me today, you are elligible to claim
    X benefit, do you wish to proceede with a claim for X benefit?"

    the system throws up the appropriate benefit you don't always just choose, a lot of people wouldn't have a clue which benefit they were entitled to as they may have never claimed benefits before...

    True, im not disputing that many people dont know and need guidance, just that someone said they were automatically placed on the benefit, which does not happen, they have to agree and go through the whole claim process before they stand a chance of being accepted.

    Usually I find when i ring the DWP it is a lottery whether I get good advice, or complete lies. Sometimes you get someone who is really good, who really knows the rules, other times you get arrogant ****ers who just lie through their teeth and make stuff up in.

    Some help, some try to put you off claiming.
