I think you need to drop the argument about it being an accident and just be truthful and remorseful.

You either claimed for 9 reused bags on purpose or it was an accident your story switches between the two versions so which one is the truth?

9 carrier bags - what's that worth? Less than 2 1/2p? Have I got my maths right? 1 point is worth 1/4p? (sorry I don't have that card so bit unsure).

When I was off sick last month for 2 weeks after my eye op, the store couldn't cope without me! They were having to phone colleagues on their days off asking could they do 4 hours later on today or tomorrow. I was planning to have a week off sick, but I was still feeling the side affects of the general anathestic and had another week off.

*picking myself up of the floor from laughing so much*

If you think a supermarket that size goes belly up if you (who can't use the self scan system properly due to dyslexia and vision problems) are not there then perhaps this rather large Blue Chip company should be closing down that particular store.

If I was you I'd give up now, any more digging you'll be in Australia!!

If there is some poor advice dispensed then I think this is it but I understand that it was meant with the best intentions.

OP is going to be disciplined for fraud so it doesn't seem a great idea for her to lie to the CAB and say she hasn't got a representative.

The CAB is voluntary and for people who really have nowhere to go whereas the OP has her union and secondly she won't learn that dishonesty doesn't pay !!!!!!

I haven't said to lie. Not anywhere in any of my posts. Maybe you need to have a reread?

The CAB will not advise you if you already have a legal adviser appointed.[/QUOTE]

"You don't tell them. You go along and tell them the situation and they'll talk it though.

Also with the solicitor - again, you're not asking for representation. You're getting advice - all of which should be covered if you have legal protection. I know - because I've used it!"

Mrcow, You actively say not to tell the CAB that you have a legal adviser appointed.

By the way, if I have misread or misinterpreted this I apologise.

I've said not to raise it. That's different to advising someone to tell lies.

The Union rep will not have all the answers. JC should be looking to get as much impartial advice as possible.

Winning cases of wrongful dismissal involves making sure that you touch all bases. Informed third parties are often able to offer arguments with different slants that can greatly enhance a claim.

As I've said earlier, I've done this before and won. Could never have done it without the range of advice I got in the beginning stages. Including from the CAB. It kept us in good stead for the rest of the process - espeically when the company in question called in the big guns.

Yes I understand that overall it's not a lot of money but making claims it's due to dyslexia or poor eyesight when the OP knew what she is doing is going to make it worse in my opinion - And from the OP's posts it seems it was done on purpose so why make up excuses now.

The best thing to do is admit she was wrong and she has realised the error of her ways and see if they will give her another chance.

They are not going to believe her if she says it was done by accident so it makes her look worse saying that.

Not in my book it isn't. It is not telling the whole truth knowingly with the purpose to mislead.

Knowingly not 'raising' something that if the CAB knew would deny you their free advice is getting something by fraudulent means !!

But I do agree with your idea that getting advice from as many people is important.

Oh dear OP, I am sorry you are in this situation for a gain of what, less than £1 overall?

3 questions / issues I would raise from reading your post:-

    1. If you knew you had problems with the SS till because of your disabilities, why on earth were you using them? You should absolutely have not used them. Especially AS YOU HAVE HIGHLIGHTED when you knew that the tills were open to abuse.

    2. Do not, absolutely, do not, blame disability on this. You will lose, guaranteed. Very poor excuse and makes you come across as dishonest and of very poor character, slimy even.

    3. Nothing to do with anybody else. You have been caught and your disciplinary relates ONLY to you. Do not hide behind anybody else and do not bring anybody else into it.

    Good luck!

I'm not sure what I find more hilarious

    1. The fact that you think the store couldn't cope without you specifically when you were off ill because they had to get people to cover (that's what tends to happen!!!!!!)

    2. You think everyone will be distraught if you leave and will protest

    3. You deciding to make up bullsh*t reasons as to why you done it despite it very much being done on purpose.

    4. The fact that you were sad enough to fraudulently claim nectar points that are worth hardly anything and risk your job in doing so!

Give up trying to make excuses etc just accept what you've done and stop thinking the store will come to a standstill without you!

So you raised your concerns about your eyes with your employer BEFORE all of this happened ? Or did you only mention this when you had been pulled in ?
