    No, I understand that, all I was saying was that a computer DOES know when a weekend / bank holiday is. But that it doesn't matter if it did or not as T&Cs clearly state you have XX days.
  • I honestly haven't got the patience for this. You have plenty of time to pay the bill, so pay it.

    I help other people when they have genuine problems with their natwest/rbs/mint/tesco card but quite frankly when it comes to late paying there are not many excuses that are the banks fault & therefore we would refund you.

    Lisa - You realise I am agreeing with you, right?

    I wasn't saying that it should take into account the weekends / bank holidays - I am saying that people should read their T&Cs because thats what you need to follow.

    I love the way people are always so overdramatic when it comes to late payment and, despite being late, how unfair because they were 'only' x amount late. But this is the best of them all, giving mention to the "2 seconds" whenever possible as if its important in any way, shape or form.

    The only important bit is that someone paid late.
  • The charges seem fair to me, and it's only gair you've been charged them. Also, as far as I understand it is illegal to record the call without asking permission first.
  • BUT - get this - because that £12 have pushed me JUST over my credit limit for that couple of seconds, they've now got me with ANOTHER £12 for being "overlimit" because their charges pushed me overlimit!

    Have you considered always making the minimum payment a few days earlier to prevent this situation happening again.

    No - too busy blaming everyone else. Maybe its the creators of time's fault - since if there were 61 seconds in a minute he wouldnt have been late

    Yes, which is why I usually start "troublesome" calls which I am recording, with the following:
    I'm obliged to let you know that this call is being recorded at (TIME) on (today)
    The recording itself will not be passed to a third party, however, depending on the outcome of this call, a transcript may be made and sent to (whoever) who are currently taking an active interest in (whatever) and looking for supporting cases. I am within my rights to do this now I have notified you, and you have no legal basis to object to the recording of the call in these circumstances, therefore are you OK to proceed with this call?
    I forget where I first read this tip, but it is perfectly legal, polite and acceptable and often produces quick results. And is doing NOTHING different than call centres do when they tell you they are recording the call.
    Worked a treat when Bulldog double-billed me, cut me off, and didn't compensate me. As soon as I made it clear a transcript was being made, I had the double-bill refund and "downtime" payment back on as a credit within the day.
    You just need to be firm, clear and polite.

    Ok - speaking on the 'legal side' of things. Do you even have to tell them that you're recording, as they are recording it themselves?!

    And seen as both parties know the call is being recorded by one member, does the other have to disclose that they are recording it as well?

    The basic rules are covered in this document; although it refers to business, I feel that when recording a transaction with a business which may be for later use, that it's better to follow the "business rules" and inform the other party.

    Quite why the bit about "the recording won't be use the the transcript may be" is there, I don't know. I assume it allows more flexibility.
