Oh clutton, i know what u sayin. Just trying to help as much as poss i spose.
The EA assured me they are still extremely interested but if the lenders 5K retention is not reduced, then they will not be able to proceed.
So by gettin these reports together which ive mentioned, the EA said by faxing them to the Lender, this will get the retention reduced - bhopefully to 1K.
The EA said that this is very likely, because even the company that said we did have all these problems (that the others said we didnt....!) they have only quotes £1000 to correct it all - so there is evidence why to reduce the 5K apparantly.0 -
is the house still on the market ? if it isn't, may i suggest that you put it back on the market, as a back-up. There is no harm in you having 2 prospective buyers fighting to get exchanged first.0

Ok we have some more developments. ....
We have been told that so far, the reports that state there is not a damp and woodworm problem have been sent to the Lender, and the Lender still is yet to respond to whether they are going to be reducing the retention.
In the mean time the party wall is still something that was picked up on the survey that obliviosly does needs completing so of course we are expecting them still to place a retention...hopefully a lot lower one!!
You would think the buyers would be chuffed that we dont have the other problems with the property as first thought, but now they are insisting that the wall is done prior to completion and that they are expecting us to foot the whole bill!!
I wonder if our buyers are reading this.....!!!!, if they are cant they see we have tried to do so much to help rectify this problem, but being forceful is not helping the situation as we are a little miffed with the demand.0 -
I must say I would feel a but miffed too, a party wall shouldnt be too expensive, are you at all handy, ie could you do the job yourself?Pawpurrs x0

i think the buyers have a flipping cheek - dont offer to pay for for partywall repairs - call their bluff, it is a small job. This is the price. Take it or leave it. Everyone has small jobs to do on new houses, you are being SO much more open and honest than many vendors, they should think themselves lucky, and no mistake. Send them the link for this thread, then at least they can see others reactions !!!!!

One question, if we managed to get someone in our family to tackle it, would we need to have a receipt or something as how will the lender know we have done it, and to therefore remove the retention?? As it wont be guaranteed if we dont get a proper builder to do it.
Has anyone on this forum attempted to complete a Firewall?? And is it a big task or not??
I just dont think I can do anything like that. I know, i am useless at anything DIY!! Some people have it, some people dont, and unfortunately i dont. I can just imagin gettin in a pickle stepping somewhere i shudnt and falling through the soddin ceiling!! Oopz!
Even tho - i have considered doing it, in a way i feel that it cant be a massive job?? But im not sure of course. Its already built up half way in anycase......little bit of cement, slap on a brick and walla!!......but then theres the cuttin of the bricks to go in the corners (the roof obliviously comes in at an angle each way to meet the apex) - nah would never be able to do it - plus my fiancee told me no straight away!! See she knows me too well. lol.!!

Hi Clutton - Yes i do think they have a cheek too. Then again im byast as its my property but i do appreciate your views. I would love to go back to them and say what you suggested, but being worried they will just pull out its something that i need to take a few days to think about.
I know the buyers family is in the building trade - (When they first came round they mentioned that a relative was a builder) . so from the start, i honestly thought with all the problems that the survey intially brought up, this was one of the problems that would not have been an issue to them. If i was able, i do think that this would be something a DIY could do.
We just dont want to risk to loose our house - even tho i really really want to say "NO"!!! We are supposed to get back to the EA with our answer on Monday....Maybe we should keep our head low for a week!!0 -
Evening, definately dont hang about try and resolve this, the problem as I see it is that your buyers are FTB and are mortgaging themselves to the hilt, and therefore proberbly need the retention lifted in order to procced, so its not a question of them just being stuborn, if the mortgage lenders hadnt put this retention on (normally only put on when the mortgage is high against property value, ie no or little deposit), then they may well of gone with it as its not a very expensive or big job.
Is any of this your fault, no. Is it fair no.
Therefore you have to weigh up if it comes to it, would you rarther pay for the work to be done, securing your buyer and securing your future house, or are you willing to start again, try and find another buyer and hope the same problem doesnt reoccur, and risk losing your house? Also risk a lower offer next time, or maybe a higher one, who knows?
By all means you can try and see if there is anyway round paying for it, ie buyer has to pay. Or perhaps a 50/50 split.

I realise you have done the majority of the work regarding the DPC and woodworm, so if I've got it right you only need the firewall estimate. Your local council should have a list of builders who have been verified if you are having difficulty in finding one. Get 2 estimates. . It should really have been down to the proposed buyers to arrange these estimates but thats another story. If they've got 'builders' in the family, they'll probably be doing the work anyway and at considerably less than the price you'll get. I know you're really keen on the house you have chosen so in order to keep the chain together, I'm afraid a further gesture on your part is likely. Also bear in mind, we are coming up to Christmas and the market goes really quiet in the few weeks leading up to it. People basicly adopt the idea that they will leave house moving until after Christmas if the move is unlikely to happen before. I do hope you get sorted. I think moving house is very stressful for most people. Regards - sally0 -
