Dfs????

Hi all,

Hoping this is a real easy one for somebody to answer.....

I'm looking to make a claim for the PPI which was put on when we bought a sofa set from DFS a couple of years back. It was put on without us realising we had it - complete mis-sell!

My question is though, do i send the claim to DFS, or does it go to Hitachi Finance which were the company we had to pay every month?

    Hi there

    I understand if it was set up by DFS, then it would be them you complain to.

    You can do this by completing the FOS questionnaire, this is in replacement of the first reclaiming template letter on this site, remember to keep a copy for yourself as well.

    They have 8 weeks in full to give a decision, but they may ask for more time, this is okay, just as long as you know where you are with this.

    Try to get proof of posting at your post office as well - good luck.

    Yes complete that stated questionnaire.

    I would send to DFS head office.

    As the setting up of the policy was dealt with by DFS, its them that is responsible, even though the payments are made to Hitachi.

    Like a loan, whoever set up the loan and added the finance is the ones responsible, for example one of mine was set up by a broker called Click and the lender was Endeavour, the payments were also made to Endeavour every month, but it was Click that I had to make the reclaiming to.

    Hope this gives more of an idea.;)

  • I don't have the address no - it'll be on the net somewhere though i guess.

    More importantly - i can't put my hand to any paperwork form DFS on this - only an account number we had with Hitachi capital as part of the agreement.

    I know we definitely 100% had PPI on the agreement cause at the time my wife and i commented on how it was rubbish that we had it put on.

    Will i need this information for the questionnaire completion?
    If so, do i need to write to DFS and request a copy of my agreement?

    The agreement will still be that of the lenders, in your case Hitachi, but if you require further paperwork, the account number will still be the same, and you can request for a Subject Access Request (SAR), they have 40 calendar days to comply and send all info they hold on you, but you enclose a payment of £10 cheque or postal order.
    Template letter here, delete what you don't think is appropriate to you.

    If you just want the agreement, then just write a simple letter to request for a copy, enclose the account number you have, and enclose a £1 cheque or postal order, ask that they supply by 12-14 days.
    I would also post by recorded delivery, for your proof of posting.

    Sometimes a SAR is helpful, so something may come back which will help with your reclaiming, but just as long as you have the account number and your reasons for being mis sold the policy - really that is fine.

    I have sent an email to them requesting a copy of the agreement but will follow up with a letter i think.

    It is a really straight forward case - they put the PPI on there without even discussing with us. Open and shut case as far as i can tell

    I'll keep you updated with how i get on - thanks!

    One last question (i promise!) - is the standard practice to send the completed questionnaire with a covering letter which simply states that unless they refund the PPI, the questionniare will be
    getting sent to the Ombudsman?
  • Proof of posting (free from Post Office) is sufficient - no need to pay for Recorded Delivery. In fact it is better because if Royal Mail don't get the signature, then it will be assumed that it was not received whereas if you just have proof of posting then FOS will assume it arrived two working days later.

    In theory you can complain to any branch but they won't know what to do with it. That is a breach of FSA rules but a reality.

    The FSA Register gives details for every regulated firm. The details for DFS are here. Note that the address is in Doncaster, not Leeds.


    And I would keep the original questionnaire and send them the copy. That way you don't have to redo it if it goes to FOS.
