Paypal Declined my Obvious Claim

I bought a mobile phone on ebay, In the listing seller didn’t mentioned that this phone is barred in UK, When I put SIM in phone it said No Service, I contacted the seller and he replied that phone was working fine with his Orange PAYG Sim, I kept saying that phone is not working and he replying that there is nothing wrong with the phone, I offered him that OK I’ll visit you and you show me the phone in working condition, If there is real problem with the phone you have to pay me travelling expenditure. He said OK send me phone back and I’ll check. All this communication was via email. I don’t want to send phone informally, I involved paypal and open a dispute and advised him give me the postal address to send the phone. After that he put a lot of things into dispute console that he offered me refund etc etc but buyer was not ready for that and escalated dispute as claim. My claim was that item not described. Paypal requested me to take that phone to local repair shop and get an estimate for repairing. The local repair shop told me that this phone is reported stolen and can’t be repaired. I contacted Orange and by IMEI number they confirmed that phone was reported stolen in January 2006, while I bought in August 2006, I requested Orange to give me in writing but they replied that they can’t put it in writing, However any one can confirm by ringing CS and quote IMEI number. I take a photo of phone with IMEI number and fax to paypal, after three days they send me reply with this:

Based on PayPal's definition of significantly not-as-described, this claim does not qualify for a refund.We found the seller to have accurately represented the item(s) in question.

I managed to get from Orange in writing afterwards paypal said case has been closed, so they can’t help. I contacted with Consumer Advice and they advice me to contact Police, I took the phone in local police station, they took the phone and gave me a receipt that they got a phone from me which is required for their enquiry, nothing else… Now I want my money back…I need advice, Shall I go to MoneyClaimOnline and register a claim against the seller? Any advice????

  • Hi if you paid with pay pal i presume you paid with a credit card?? if you did phone your credit card company up and explain to them and they should do a charge back for you, as for some reason even though paypal pay the seller your money doesnt leave your bank for 45 days (its in limbo!)

    I have had to do this a couple of times and they always have let me do a charge back.

    I would second the chargeback via credit card, if that isnt an option or you dont get your money back that way then i would go ahean with the moneyclaim online if it was me

    Why not :confused: ? I didn't know there was a minimum you had to spend in order to claim from your CC company if something goes wrong.

  • Well, by definition, the card provider is legally obliged to step in only if the amount is over £100. However, some card providers are nicer and will take up matters for smaller amounts as well.

    all i can say my credit card company have done 3 for me all under £30 none of them where over £100 i would give them a ring and ask its not gonner hurt is it!

    Yup mine has helped me out for low value items too. Did you pay for shipping on top of the £99 that would take the transaction value over £100?

    If you get no joy from the credit card company then begin county court action. It isnt as scary as it sounds and Ive had nothing but success using that process.

    Finally, you should also push the police into taking action on the stolen mobile. There really is little investigation needed as far as they are concerned. Take copies of the listing on eBay while its still there and obtain full contact details for the seller though eBay too and keep nagging the police. I hope you have left a negative to warn other buyers of this seller? Why not let us have their i.d.?
