MCO Capital loan

Hi - first time user of a forum !
Got home yesterday to find letter from Balanceloan waiting. Needless to say spent next couple of hours trying to work out who they were. Thanks for all the helpful comments on the forum.
I have now written to MCO Capital at two addresses and have emailed them.
If it helps the text of my letter was :
"Reference : [insert loan ref number]
Subject : Loan Agreement
I refer to the above matter and your letter dated 10 September (received 30 September 2010) demanding payment of an alleged loan (taken out on or about 10 September 2010 in the name of [insert name] by 8 October 2010.
Please note that I have not taken out the alleged or any loan with Balanceloan or any associated company to Balanceloan or MCO Capital Limited and therefore no credit agreement between myself and MCO Capital Limited exists or has ever existed and it is therefore likely that a fraudulent application (as a result of identity theft) has been made illegally using my personal details for which I have no legal responsibility.
In the circumstances, I require written confirmation by return that the above loan agreement has been cancelled and my details removed from your database and any third party database under your control. In the meantime this matter has been reported to the appropriate authorities and is under investigation (Crime Reference Number : [insert ref number]).
Please also treat this letter as formal notice that I reserve the right to hold MCO Capital Limited responsible for any wasted costs (including but not limited to my wasted time) in dealing with this matter."
I don't expect to get a reply but at lease it puts my position on record.
I am a lawyer in the financial services industry (not that MCO Capital will care) so will cast my eye around to see if I can find anything more out about this scam. I think a stiff letter to the FSA and BBA is also called for.
I will update if I get any meaningful response from MCO.
Heck Wigw, you are a brave man, confessing to being both a lawyer and in the financial services industry ;-)
If you read the rest of this thread (it may take a while) you'll soon get the picture of what's going on. It's essential that Actionfraud are contacted, as stiff letters to bureacracy that moves at a pace where they are likely to be overtaken by glaciers, will not be helpful.
Thanks for the helpful legal based form letter, I'm sure that will help many.0 -
I didn't, but they may have tied up my call back details with my details when I got through to them.
The AF website now says it will take FIVE DAYS to call you back and are asking people to use the online reporting tool. I know that some posts here say that they can't get through the maze of the online tool, but there are a couple of posts that explain exactly how to do it.0 -

The best advice is to keep trying and NOT to select button 1 directing you to MCO issues!! (Don't tell anyone!!:D).0 -
Hi WigW
Welcome aboard and your legal insight is much appreciated.
That said, I would strongly urge you to contact Action Fraud (at 0300 123 2040) as they are the public window/gateway to the National Fraud Investigation Branch and the more complainees there are the better (as advised by an AF agent). Once you get your CRN from AF, it is recommended that you write to MCO again (at their registered office) quoting the CRN.0 -
Thanks colinho,
At last, they've finally got the message!
And a quick message for geomacl. Yep, my letter came from Helploan too.
After everything that has happened this week, I've only just contacted Intrum Justitia, and the bloke on the phone sounded really fed up. It was dealt with very swiftly by them.
Hi OB - what was the nature/outcome of your swift telephone conversation with IF?
A local bobby called them on my behalf last Saturday morning and I was advised (via the bobby) that my loan reference had been cancelled and that I would hear no more -altruism is the reason for my hanging around the forum:cool::D0 -
Hi geomacl,
I rang IJ's switchboard, as I didn't really want "Customer Services", but was put through anyway. The guy asked me for my details and then told me to call AF. I told him I'd already got a CRN, and he saidd the police were now dealing with this.....that was it. I'll write to MCO at Imperial House when I've got time.....perhaps the NFIB will pick it up when they knock on that door!0 -
Thanks WigW,
I'll use your draft letter for my response to MCO...especially like the last paragraph of that!!
Thanks0 -

I am very puzzled as to why new letters are still being sent out and received (as evidenced by new posts on this forum0???:eek:0 -

That's easy....the debts aren't due yet.
My letter was dated 6.9.10. The start date on the letter was 6.9.10, due 4.10.10, received by me on 24.9.10.
Any start date later in September may not have gone out yet.....and may not go out now....we'll have to wait and see, but I definitely think that this is the 'end game' in this scam.
If I'm wrong, we'll all still be on this thread at the end of October! It doesn't really matter though, we know that we're right, we've done the right things, and we've supported and encouraged each other as well. That more could we want?....other than answers from Experian!0
