As and when I hear something positive that I can release I'll let this forum know.

I for one welcome your input Robie. I hope the investigation goes well and the perpetrators are caught quickly. I am hoping that because the fraudsters found this scam so easy, they will have got greedy and made mistakes which will help lead the authorities to their door.

In answer to a specific attack in that I don't understand how this has affected people - yes I do. I had my bank account cleared out with cloned cards a couple of years ago and know perfectly well the misery, hassle that financial fraud causes.

Fair enough Robie, but if you re-read what I said, I actually said if you were a victim of this fraud. Not fraud in general. But hey I am splitting hairs and if you want to bow out of a debate then again fair enough I shan't "attack" you further.

I am now on the 4th letter despite having followed all the advice here and AF guidance - received on 28th October (sent 22 October from IJ).

I also got an extra letter from IJ 10 days after phone reassurances that the matter was closed. Another phone call - and an actual apology. I am optimistic that it really is the end now IJ have gone on record to the BBC that they will not send any more MCO-related letters.
(I can't post the link but google "help loan debt collection halted".)

Thanks George - here's the web link (they will let you post links after a few more posts!!)

    Selected quotes from above
"However, Pascal Lebreu, who is responsible for Intrum Justitia’s UK operations, says that since 27 October no more enforcement action has been taken against anyone alleged to owe MCO Capital money".
"We have decided to stop all reminder action on MCO cases. The level of fraud seems to be very high.”
"MCO Capital says it already has a process in place so innocent people are not pursued." Adrian Kibbler, who speaks on behalf of the firm, said: “We are very sorry people have received distressing letters. If people believe they have been the victim of identity fraud, they can contact the company, there will be an investigation and the case will be closed.”"

Let's watch to see if these promises are met!!!

Hi Jahman, know you've got a lot on your plate, but did you have a chance to think about contacting solicitors? I'm happy if you want to explore if we can get a compensation claim going for everyone involved (but I dont want to duplicate anything you're doing or tread on your toes). As many have CRN's, this means the police recognise a crime has already been committed by MCO. This will be attractive to many enterprising compensation firms. I think we'll be able to get a big compensation claim underway. If MCO dont have the assets to pay, their third party liability insurer's should. If they don't we should get the compensation from the Government's criminal compensation fund. Think we need to start focussing on seeking damages now; this is useful in several ways. We can claim the compensation we deserve. We can get MCO to recognise their biggest threat now will be from the crimes they have committed. It might send a message to other companies involved in the same type of criminal scam.

I am not a lawyer GQ and I'd be interested to hear what others have got to say but I have a horrible feeling that MCO Capital has not actually committed any crime to do with the part of scam we have got caught up in (the granting of loans to fraudsters).

I wonder if anyone with a knowledge of campany law has been a victim of this scam and is reading this thread - if so, can you comment?

PS I am not a MCO Capital mole!!

Thanks for that Pru... never thought for one minute you were a mole! I'm no lawyer, but if you consider the letters sent as demanding money in a menacing manner, then this has been illegal. It is reinforced by the fact that Shropshire Police report some have actually repaid money that they didn't owe. I'm confident we can get a legal compensation claim going, but will not do this until Jahman gets back as it was his idea, and he may already have investigated this. How's your Dad by the way Jahman? Hope he's doing OK. I can get a few legal views on this tomorrow, which I can feed back, but will only proceed with Jahman's agreement and consent. What would be useful right now is a feel for the compensation victims feel they should be entitled to. You could work this out on a cost (Experian etc) plus time element, or may be some people had to have time off work? Jahman typifies a case where serious damage could have been done and therefore a serious claim should be considered. Any input from anyone appreciated, including compensation lawyers looking for early retirement! With 10,000 potential customers, this is a huge opportunity.

Just done some research - with good lawyers this could be "demanding money with menaces". Lots of legal precedents for this. Fine is £1000, max sentance 14 years.

Hi fellow posters. For what it is worth, I am in favour of some sort of legal action against either MCO or IJ or both. It would be interesting to have some sort of legal perspective - is there anyone out there who can provide some sort of perspective on such an action?
