If you were correct, why would the OP's insurer be taking the major step of cancelling his policy and blighting him for life?
Get your underwriter to confirm his bad advice in writing! That way you will have an argument should your client get found out as has the OP.
(And up to now you have used the excuse you don't sully your hands with "personal lines" - maybe you need some training in what is required to be declared on proposals for motor insurance if you are now offering a way to get it without declaring previous claims on policies unless the policyholder was driving at the time)0 -

I think we all agree if she made a claim in her own right it wouldn't need to be declared.
You say it's the daughters claim, so that's what you asked, Kwik Fit say it's the OP's claim, that's still what we're discussing.
still cant be the OP claim when hes not the one making the claim his daughter is it just happens to be on the OP policy to which she is a named driver.
Im happy with what ive posted in all honesty regardless of Quentins rants about my own training requirements which has been reported by the way.
I did state I wasnt sure and ive gone away and gained some clarification from 2 insurers what the OP does with that is up to him but I would be making a complaint.0 -
I don't wish to continue the row, and I think the op should take it further, but I can't agree as I don't think you have asked the right question, it is the wrong advice, so it will just get his complaint thrown back out.
Better to plead a genuine mistake, and try to pay the increase in premiums.
From your posting,
if my wife writes off my car, if she makes a claim as a named driver, I will get the replacement car, all I have to do it take her off my insurance, and I can declare no claims and my premiums will not increase?
I would also be better off cancelling the insurance as well, and re-using last years proof of no claims, otherwise surely the present insurance company will knock my ncd down, and insurance will again go up? That just can't be correct.0 -

Firstly I dont beleive were rowing I see it as a debate neither of us has got personal unlike Quentin.
Secondly it doesnt quite work like that if you were to cancel the policy there would be a gap in cover which any new insurers would pick up on plus the NCD would be on a vehicle that had been written off and again would be questioned.
Think of it this way if the OP took a policy with his daughter named this year who would the claim be attached to (look at any motor insurance porposal form and you will see claims are always attached to an individual). it would be attached to his daughter and not the OP name in any way shape or form. So why then take daughter off is the claim suddenly being attached to teh OP ?0 -

My ncd is atached to me, not my car.
Think of it my way, it's my policy, my named driver, my car, my claim, my mistake.

The question then reverts to the proposer:Have you made any claims or suffered in any losses in the past 5 years.....
The answer is "yes". The claim was made against the OP's policy, not his daughter's.0 -

Quentin is of course correct. The claim is registered against the policyholder and it will be shown on CUE in the policyholders name.
The OP chose to arrange cover online and did not declare, so they have stitched themselves up. Kwik Fit are quite entitled to cancel the policy on the basis that a breach of trust has taken place. What the OP should do now, is just ask Kwik Fit for a letter explaining the circumstances. Any new Insurers will ask for details of why the previous Insurers cancelled the policy. With the letter (provided it helps) the OP may be able to obtain Insurance through a mainstream Insurer and not be limited to 'niche' companies.The comments I post are personal opinion. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0 -

The actual Kwik Fit words are
"Have you made any claims or suffered in any losses in the past 5 years? This includes any non-fault claims and/or any incidents you have been involved in, even if you did not claim."0 -
Quentin is correct I am afraid.
The claim is against the OP's POLICY so the OP needs to declare.
However, If Kwik Fit did not ask the question correctly then there is maybe a get out clause.

Haven't read through the whole thread, but you were probably asked at inception of the policy whether you had any accidents or claims in the last 5 years. An accident isn't necessarily a claim and vice versa.
Check your statement of fact that they would have sent you to see what the wording is. Chances are, that it will say accident or claims, if it only says accidents, I suppose you could argue that, as you haven't had an accident (but you have had a claim).
You say it's with Kwik-Fit, they're the broker, who is the policy underwritten by!0
